La politique locale de l'habitat est conçue comme une politique d'insertion, urbaine tout d'abord, à travers la prise en compte du logement par la politique de l'urbanisme, mais également sociale, à travers la prise en charge de l'habitant par les politiques mises en œuvre à cet effet. La loi LRL du 13 août 2004 a engagé un mouvement de territorialisation de la politique de l'habitat qui repose sur plusieurs techniques de répartition des compétences : la décentralisation classique, la décentralisation à la carte et la délégation de compétences. C'est donc le pragmatisme qui a guidé le législateur, mais aussi la volonté de ne partager les compétences de l'Etat qu'au stade de la mise en œuvre de la politique de l'habitat. Après avoir redéfini l'architecture institutionnelle de la politique de l'habitat, le législateur a renforcé les droits et obligations des collectivités et de leurs groupements dans sa mise en œuvre. La loi ENL du 13 juillet 2006 n'institue pas un droit au logement opposable mais propose des avancées pour un droit au logement effectif. Elle prend en compte le nouveau partage de responsabilité qui résulte de la loi LRL et qui tend à renforcer le rôle des intercommunalités sans remettre en cause celui de l'Etat, qui reste seul garant du droit au logement. Ce guide complet, à la fois pratique et pédagogique, qui intègre les dispositions textuelles et les données jurisprudentielles les plus récentes, présente les différents dispositifs et recense les problèmes posés par leur choix, leur utilisation, leur financement, leur évaluation et leur efficacité. Prospectif, il développe les différents enjeux de la politique locale de l'habitat, qu'il s'agisse de sa territorialisation, du respect du principe de diversité, mais aussi de l'accès au logement des personnes défavorisées, de l'amélioration de l'habitat ou de son adaptation aux demandes spécifiques.
