The International Ombudsman Yearbook is the only publication devoted to ombudsman issues. The public sector ombudsman is now found at all levels of government in many countries around the world, both in established and consolidating democracies. The ombudsman is an independent office, traditionally appointed by the legislative branch, to investigate poor administration of government. More recently, some ombudsman offices have been given human rights protection responsibilities. The International Ombudsman Yearbook contains articles written from legal or public administration perspectives which address issues of interest to the contemporary ombudsman and to all persons with an interest in the institution. Compiled and edited by the International Ombudsman Institute, the organization composed of over 130 ombudsman members located worldwide, The Yearbook will be of interest to lawyers, scholars, ombudsman office personnel, and government entities wherever ombudsman offices are located or contemplated.

Tribunals for Users

Tribunals for Users PDF Author: Andrew Peter Leggatt
Publisher: Stationery Office Books (TSO)
ISBN: 9780117027312
Category : Administrative courts
Languages : en
Pages : 263

Book Description
This review of tribunals, the first for 44 years, examines the 70 different administrative tribunals in England and Wales. They deal with over a million cases a year, employ over 3500 people, and have become a substantial part of the system of justice. Yet, of the 70, only 20 each hear more than 500 cases a year; others are defunct; the quality of their work is variable; and cases take too long. The review has as its four main objectives: (1) to make the 70 tribunals into one Tribunals Service; (2) to make the tribunals independent of their sponsoring departments; (3) to improve the training of chairmen and members in the interpersonal skills required; (4) to enable unrepresented users to participate effectively and without apprehension in tribunal proceedings. The new Tribunals Service would provide a coherence essential if tribunals are to acquire a collective standing to match that of the court system. But there is also a basic need for a change in culture, with a greater focus on the users' needs, and swifter administration based on informality, simplicity, efficiency and proportionality. Without this culture change, the Review questions how tribunals can, as presently administered, find the independence, coherence, economies of scale, consistency, professionalism or IT, to which users are entitled.

The Future of Civil Litigation

The Future of Civil Litigation PDF Author: Laura Ervo
Publisher: Springer
ISBN: 3319044656
Category : Law
Languages : en
Pages : 424

Book Description
This book offers an analysis of the current trends and developments in Nordic civil litigation and is divided into four main parts. In the first part a picture of the current civil litigation landscape is provided by focusing on whether there is a truly Nordic form of civil litigation, the current state of Nordic civil litigation, the recent major reforms of civil procedure legislation and the effects of Europeanization. In the second part, the way rules on court-connected mediation have been implemented and practiced in the Nordic countries is discussed. The authors offer their insights on why court-connected mediation has not been fully embraced by Nordic lawyers and the Nordic approach to this type of mediation is contrasted with the Austrian and German approaches. In the third part, recent developments affecting access to justice in the Nordic countries are discussed. Among the topics are changes in legal aid schemes, the impact of recent civil procedure law reforms, hindrances for larger companies to use litigation as a method of dispute resolution and differences in costs and delays. Additionally, Alternative Dispute Resolution and Class or Group Actions are explored as methods to enhance access to justice. The potential adverse effects of Alternative Dispute Resolution and Group Actions are also examined, both in a Nordic and European context. In the final part, conclusions are drawn from both historical and future-oriented perspectives.
