This book provides an in-depth survey of Britain’s Mandate in Palestine, an issue crucial to understanding the continuing atmosphere of mistrust and violence in the region that continues to the present. At the conclusion of the First World War (1914–18), the League of Nations awarded a Mandate to Great Britain, which entailed governing a part of the defunct Ottoman Empire, a part which became known as Palestine. The Mandate, empowering Britain to govern this area for an unspecified period, had as one of its main objectives the understanding that Britain would assist the Zionist Movement in the creation of a Homeland for the Jewish people in Palestine. During the thirty years that Britain ruled Palestine, it made no serious effort to carry out this commitment. The author discusses a variety of reasons for this failure, but the greatest obstacle preventing it from fulfilling its Mandate was that Britain completely miscalculated the reaction of the large Arab majority in the country. In fear of repercussions from the growing Arab nationalism various British Governments over the years decided that their best interests would be served by appeasing the Palestine Arabs and reneging on the British promise to Zionism. After overthrowing the Mongol Yuan dynasty, Zhu Yuanzhang, the founder of the Ming dynasty (1368-1644), proclaimed that he had obtained the Mandate of Heaven (Tianming), enabling establishment of a spiritual orientation and social agenda for China. Zhu, emperor during the Ming’s Hongwu reign period, launched a series of social programs to rebuild the empire and define Chinese cultural identity. To promote its reform programs, the Ming imperial court issued a series of legal documents, culminating in The Great Ming Code (Da Ming lu), which supported China’s legal system until the Ming was overthrown and also served as the basis of the legal code of the following dynasty, the Qing (1644-1911). This companion volume to Jiang Yonglin’s translation of The Great Ming Code (2005) analyzes the thought underlying the imperial legal code. Was the concept of the Mandate of Heaven merely a tool manipulated by the ruling elite to justify state power, or was it essential to their belief system and to the intellectual foundation of legal culture? What role did law play in the imperial effort to carry out the social reform programs? Jiang addresses these questions by examining the transformative role of the Code in educating the people about the Mandate of Heaven. The Code served as a cosmic instrument and moral textbook to ensure “all under Heaven” were aligned with the cosmic order. By promoting, regulating, and prohibiting categories of ritual behavior, the intent of the Code was to provide spiritual guidance to Chinese subjects, as well as to acquire political legitimacy. The Code also obligated officials to obey the supreme authority of the emperor, to observe filial behavior toward parents, to care for the welfare of the masses, and to maintain harmonious relationships with deities. This set of regulations made officials the representatives of the Son of Heaven in mediating between the spiritual and mundane worlds and in governing the human realm. This study challenges the conventional assumption that law in premodern China was used merely as an arm of the state to maintain social control and as a secular tool to exercise naked power. Based on a holistic approach, Jiang argues that the Ming ruling elite envisioned the cosmos as an integrated unit; they saw law, religion, and political power as intertwined, remarkably different from the “modern” compartmentalized worldview. Whether or not voters consciously use their votes to send messages about their preferences for public policy, the Washington community sometimes comes to believe that it has heard such a message. In this 2006 book the authors ask 'What then happens?' They focus on these perceived mandates - where they come from and how they alter the behaviors of members of Congress, the media, and voters. These events are rare. Only three elections in post-war America (1964, 1980 and 1994) were declared mandates by the media consensus. In this volume, Brownson sheds new light on Palestinian Muslim women’s agency in shari‘a courts from the British Mandate period to the present. Her extensive archival research on wife-initiated maintenance claims, divorce, and child custody cases deepens our understanding of women’s position in the courts, demonstrating that Muslim women were and are active participants in their legal affairs. Using court registers and interviews, Brownson uncovers a variety of ways women have manipulated the system to their benefit despite its patriarchal bias. She also finds that few reforms were implemented during the Mandate period. The British were uninterested in improving colonized women’s legal status and sought to avoid further antagonizing Palestinians. At the same time, Palestinians wished to uphold the one indigenous institution they still controlled while both British rule and Zionism threatened their nationalist aspirations. Although Palestinian women have had few alternatives to using this male privileged system to redress grievances with their husbands and in-laws, they continue to resist its injustices every day. Brownson finds that women’s understanding of family law fundamentals has enabled some to deftly navigate the system; however, a unified, reformed law reflecting society's current needs is required so women can have full access to their rights.
