Book Description
Excerpt from A Selection of Cases on the Law of Quasi-Contracts, Vol. 1 That quasi-contracts has been chosen as a title will not be a surprise to any one familiar with the confusion existing in the cases in consequence of the indiscriminate use of the term Implied Con tract, - the term being used not only with reference to a contract implied in law, which is not a contract at all, but also with reference to a contract implied in fact, which is a true contract. It is safe to say that the development of this branch of the law has been much retarded by a confusion of ideas consequent upon this confusion of terms. Book Description
Excerpt from A Treatise on the Law of Quasi-Contracts The reason for the publication of this work is the fact no attempt has hitherto been made to treat exhaustively the topics here considered. The ground covered is indicated sufficiently in the first chapter, dealing with the nature and scope of Quasi-Contracts. In substituting the term "Quasi-Contract" for the term "Contract implied in Law," the writer has only followed the lead of Sir Frederick Pollock and Sir William Anson. While under such leadership the propriety of the substitution does not admit of question, the necessity therefor will soon become apparent to the reader. Book Description
Excerpt from The Law of Quasi Contracts Professor Keener's treatise on Quasi Contracts appeared in 1893. It has done much to clarify the views of lawyers and teachers, and undoubtedly has had a salutary influence in the development of the law. For some time, however, there has been urgent need of a book containing a further analysis and classification of quasi contractual obligations, a more thorough treatment of many parts of the subject, and a larger collee tion of modern authorities. It was with the hope of meet ing this need that the present work was undertaken. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Handbook of the Law of Contracts (Classic Reprint) PDF Author: William L. Clark Jr.

Book Description
Excerpt from Handbook of the Law of Contracts In preparing the present edition the editor has had the benefit of suggestions made by many instructors who have used Mr. Clark's book in the class room. Some new matter has been added, which has led to the condensation of portions of the original text; and some cases formerly cited have been omitted to make room for more recent cases, but the editor has endeavored to retain all leading cases cited by Mr. Clark. The chapters on Agency and Quasi Contracts, although per haps somewhat beyond the scope of an elementary book on Contracts, have been retained with little change, for the benefit of schools which do not make these topics the subjects of separate courses. Book Description
Excerpt from The Law of Contracts, Vol. 1 of 4 One who attempts to write on any topic of the law is likely to realize that what Maitland said of the historian is also true of the law writer, - he is tearing a seamless web. The law can not be divided into parts marked by exact boundaries, and the problem of where to stop continually confronts him. But how ever vague may be the boundaries of contract, it fills so large a space in the law that the most formidable obstacle presented to one who chooses the subject is its magnitude. Included within it are large portions of what 18 contained ln works on Vendor and Purchaser, Sales of Personal Property, Negotiable Instruments, Agency, Bailments, Carriers, Landlord and Ten ant, Insurance, Suretyship, Equity, Master and Servant, Quasi Contract, Damages, Evidence. Book Description
Excerpt from Selected Cases on the Law of Quasi-Contracts This volume is intended to contain a representative selection of cases upon the large and important group of legal duties embraced in the term quasi-contract, and to afford material for the study and discussion of the principles regulating recovery in that class of cases, as those principles are found implicated with, and working upon, the actual facts of decided cases. For the historical development of the law of quasi-contracts, the student is referred to the masterly History of Assumpsit, by Professor Ames, which he has kindly permitted to be republished as an appendix to this volume. The primary division of the work into three parts was determined by the broad classification first given by Professor Ames in his History of Assumpsit, and adopted by Professor Keener in the introductory chapter to his Treatise on Quasi-Contracts. However, by far the greater part of the subject is comprised in Part III, under the general doctrine of "Unjust Enrichment," and the arrangement employed by the present editor for this part, while not the only feasible grouping, will, it is hoped, be practically satisfactory. As Dr. Johnson says in his essay on Pope: "Of two or more positions depending upon some remote or general principle, there is seldom any cogent reason why one should precede the other;" and so, while the cases in Part III depend upon the very general principle of "Unjust Enrichment," and while a cogent reason cannot always be given why some of these positions should precede others, nevertheless the special correlation of analogous topics has been the guide to the present arrangement. It may be added that the only essay at a completely developed classification of the law of quasi-contracts which has thus far been published, is the one offered tentatively by Professor Wigmore, in 25 American Laiv Reznezv, 695 (1891).
