Also it has been held that in mandamus proceedings against a town treasurer to compel the payment of an order drawn by the town clerk on a claim allowed by the town board, it is competent for him to allege that the order was erroneously issued, that the claim is fraudulent, and that in fact the town was not indebted upon the claim, as justifying his refusal to pay. In such a case the writ will not issue, but the petitioner will be remitted to his action at law to establish therein the validity of his claim. The rule declared by the court was that 1rum-llamua would not issue against a municipal corporation to compel the payment of a claim unless in a clear case of indebtedness.' A similar rule was declared by another court. It was said it is the duty of a county treasurer under ordinary circumstances to pay the warrants drawn according to law by the board of county commissioners, when he has funds in his hands for that purpose. If, however, he has reasonable grounds to question the legality of the warrant or the power of the commissioners to draw the same, he is justified in refusing to pay such warrant until the validity of the same is established by the judgment of a court of competent jurisdiction.'
