Master's Thesis from the year 2021 in the subject Politics - International Politics - Topic: European Union, grade: 1,7, Leiden University, language: English, abstract: This Thesis looks at the question of whether the general equality principle, in its current form of the obligation of the Member States to pay social benefits also to EU migrants as laid down in Directive 2004/38/EC has the potential to endanger the further unification of the Member States and if such potential risk could be overcome by different handling of such obligation in line with EU primary law. In the process of European integration, more and more sovereign competences were shifted from the nation-states to the institutions of the European Union. The path from the establishment of a common administration for the coal and steel industry, the creation of a customs union, a common internal market, an economic and monetary union to finally the introduction of a common currency for a large part of the Member States aimed the establishment of an "ever closer union", as laid down in the preamble to the TFEU. This integration process also included the implementation of common European values. On this path, the value of "equality" and especially its expression of non-discrimination based on nationality lead to discussions. Whereas initially only a common market with economic equality was envisaged, based on the idea of an "ever closer union" more and more citizens' rights have been harmonised with the result that in areas of EU relevance EU migrants may no longer be treated differently than nationals of a Member State. Especially equal treatment of economically non-active persons is a politically sensitive issue, as it is feared that their free movement may lead to so-called "benefit tourism".

The regulation of the free movement of workers in the European Union (EU), and specifically EU (migrant) workers' access to welfare benefits in the host country, has generated considerable political conflicts within and across EU Member States in recent years. These conflicts have the potential to threaten the future political sustainability of unrestricted intra-EU labour mobility and broader processes of European integration. In this paper, we provide an institutional analysis of one specific issue that has been at the heart of these debates: the exportability of child benefits. Under the current EU rules, 'EU workers' (i.e. mobile EU citizens who live and work in a Member State where they do not hold national citizenship) can “export” family benefits to their children and other family members resident in the home country. A number of EU countries have demanded a change to these rules. We argue that the political conflicts about exporting child benefits are, at least in part, due to a fundamental tension between the 'employment-based' institutional logic that regulates EU workers' access to child and family benefits and the 'residence-based' institutional logic that underpins family policy in all Member States. To reduce this tension, we make the case for changing the principles for coordinating EU workers' access to welfare benefits, which would mean, as a consequence, that the exportability of child benefits would no longer apply. It is the country where the child lives, rather than the country where the working parent/spouse ('breadwinner') is employed that should bear the responsibility for providing child benefits.

While international mobility has developed into a major driver of population change in the European Union, people with immigrant background in the Member States continue to be placed in disadvantaged socio-economic positions. They are often hampered by a lack of host country specific skills and knowledge. Many native-born children of immigrants – the “second generation” – obtain lower levels of educational achievement than those of non-immigrant background. In consequence, migrants tend to show lower labour market activity rates and income levels compared with people without immigrant background. They also tend to be exposed to higher risks of unemployment and depend on social welfare more often. These stylized facts indicate that the provision of proper education to people with immigrant background is an important element in policies for building a more inclusive society in Europe. It may also help enhance competitiveness of the European knowledge-based economies. The purpose of this report is to provide an overview about the potential economic returns to education of migrants at the aggregate level. It covers the current state of economics research as regards returns in three different areas: economic output and growth, labour markets, and governmental budgets. The challenge in doing so is that populations with immigrant background and their economic stance are hugely diverse across Member States, and that quality empirical research findings on the topic in sum are still fairly limited, fragmented, and case specific. Hence there is little scope for meaningful cross-country comparisons and all-encompassing cost-benefit analyses in this field.

This book provides a major new examination of the current dilemmas of liberal anti-racist policies in European societies, linking two discourses that are normally quite separate in social science: immigration and ethnic relations research on the one hand, and the political economy of the welfare state on the other. The authors rephrase Gunnar Myrdal's questions in An American Dilemma with reference to Europe's current dual crisis - that of the established welfare statefacing a declining capacity to maintain equity, and that of the nation state unable to accommodate incremental ethnic diversity. They compare developments across the European Union with the contemporary US experience of poverty, race, and class. They highlight the major moral-political dilemma emerging acrossthe EU out of the discord between declared ideals of citizenship and actual exclusion from civil, political, and social rights. Pursuing this overall European predicament, the authors provide a critical scrutiny of the EU's growing policy involvement in the fields of international migration, integration, discrimination, and racism.
