This book discusses the law and practice of the European Union's new chemical regulatory programmes known under the acronym ''REACH'. REACH is intended to ensure the safe management of risks associated with chemical substances throughout the supply chain. Its scope is very broad; subject to limited exceptions, REACH applies to all bulk chemicals used in industrial processes and to chemicals present in products such as cleaning products, paints, clothing, furniture, and electrical appliances. The newly established European Chemicals Agency (ECHA), the Commission, and member state authorities are in charge of administering the various parts of the REACH Regulation, creating a complex patchwork of government powers, procedures, and oversight. The volume is written by experienced REACH practitioners. It addresses both the key legal regulatory issues associated with REACH and the key management and practical challenges. The focus is on the strategic and practical decisions facing companies subject to REACH's various regimes. Significant attention is paid to REACH consortia, which are a key instrument in compliance management, and to the competition law issues arising in connection with REACH consortia. It also covers legal remedies, enforcement, intellectual property rights, and civil liability for damages arising from chemical substances as well as how companies can shape their REACH compliance programme to reduce their liability exposure.

This volume presents research on current trends in chemical regulations – a fa- growing, complex, and increasingly internationalized field. The book grew out from a multidisciplinary research project entitled ‘Regulating Chemical Risks in the Baltic Sea Area: Science, Politics, and the Media’, led by Michael Gilek at Södertörn University, Sweden. This research project involved scholars and experts from natural as well as social sciences, based at Södertörn University, Swedish Royal Institute of Technology (KTH), Karolinska Institutet, and Umeå University. The project group organized a multidisciplinary research conference on chemical risk regulations, held in Stockholm, August 15–17, 2007. Most of the contributions published in this book were, in draft form, first presented at this conference. The conference, like the ensuing edited volume, expanded the geographical focus beyond the Baltic Sea area to include wider European, and to some extent also global trends. On June 1, 2007, the European Union (EU) began to implement a new law, Registration, Evaluation, Authorization, and Restriction of Chemicals (REACH), in EU commerce. It is intended to protect human health and the environment from hazardous chemicals while at the same time protecting the competitiveness of European industry. REACH evolved over eight years and reflects compromises reached among EU stakeholders. The final regulation reduces and coordinates EU regulatory requirements for chemicals new to the EU market and increases collection of such information for chemicals already in the EU market, thus potentially removing disincentives to innovation. It also shifts responsibility for safety assessments from government to industry and encourages substitution of less toxic for more toxic chemicals in various chemical applications. The Bush Administration expressed concerns about its trade implications for U.S.-produced chemicals. U.S. chemical industry representatives believe that REACH is "impractical." In contrast, some public-interest groups are urging U.S. legislators to adopt a similar legislative approach.
