The history of the world trading system and international trade agreements is characterised by shifts between bilateralism, regionalism and multilateralism. Bilateralism has recently returned, having gained momentum following the failed WTO negotiations at the 1999 Seattle Ministerial Conference. The result is that today's international trade rules are now a complex web of instruments and agreements. This volume contains case studies of selected bilateral and regional free trade agreements (FTAs), covering a wide range of countries, regions and key issues such as intellectual property and agriculture. This volume tests the claim that, as combinations of Civil and Common Law influences, the mixed systems of contract law in Scotland and South Africa have anticipated the content of the Principles of European Contract Law (PECL) concluded and published in 2003 by the unofficial Commission on European Contract Law. Going further, it rigorously explores what the implications of a Europe-wide contract law would be. The current official moves towards a European contract law within the European Union make the critiques of PECL in this volume especially urgent and significant. With a European contract law nearer to reality than ever before, mere policy critiques are no longer enough. The global 'financial' crisis at the turn of the decade has accelerated changes in the relative standing of major regions. Looking at the negotiating strategies of India and several other WTO members over the years, this volume explores the negotiating scenario and the concerns for India and other developing countries. The introduction notes that judging by the experience of Cancun (2003) and the recent Hong Kong Ministerial (2005), developing countries are fast emerging as quick learners of the rules of the game, but need to sharpen those skills further: "It is quite prudent to understand that hidden from public glare, both the battle and the war will now continue in Geneva, which is less of a free trade bastion than Hong Kong. It is by now a time-honoured fact that the intensity of liberalisation undertaken at home makes handling the WTO-induced reforms easier, and the priorities for Indian policy makers are therefore, obvious. Notwithstanding the WTO objective, even eleven years after the inception of the multilateral body, the trade barriers, both in developed and developing countries are quite significant and unilateral liberalisation is not easily forthcoming. Although this lack of market access hurt the developing countries much more severely than their developed counterparts, the former group never systematically bargained at the negotiating table with the latter before the Doha Ministerial (2001). Looking at the negotiating strategies of India and several other WTO members over the years, the nine papers in this volume explore the current negotiating scenario and the concerns for India and other developing countries. While some papers attempt to chalk out the future of global free trade and the determinants of protectionism of major players, the other ones look into the future of India's sectoral negotiating strategy.

Bi- and multilateral trade relations between external actors and individual African states or regional blocs are becoming ever more decisive. The trade policies of both the USA and the EU are anything but helpful. This is true of the USAs African Growth and Opportunity Act (AGOA), the EU Free Trade Agreement (FTA) with South Africa and more recently the Economic Partnership Agreements (EPAs) negotiated in the Post-Cotonou era of European relations with the South. All these initiatives have a potentially detrimental impact on regional integration. The latter remains, however, a priority in the developmental policy and strategy documents as formulated both by African agencies as well as the partners in development cooperation in the OECD countries. Hence the question of coherence between trade as aid and other areas of development strategy and cooperation remains to be answered. This book addresses timely concerns of rising African nationalism and the 2nd decolonisation in Africa. The wholesale rejection of all things considered ‘Western’ is seen to be a result of ‘integrationalism’, defined as the specific kind of methodology by which EU foreign policy engagement may be interpreted. Using complexity theory and panarchy, a specific arrangement of interacting complex adaptive systems together with a ‘resilience assessment’, the EU’s foreign policy is shown to be undermining the aims of the premier African institution, the AU, created to provide unity and security on the continent: the EU pursues these objectives in its own image rather than honouring African values. This book raises awareness of these issues, as well as to widen the application of the theoretical framework in international relations and politics, which is becoming increasingly important in a complex world. The aim of this book is to show that the negative isolationism pursued in order to counteract western influence is not the answer and can be avoided through this awareness.

Collective bargaining involves a process of negotiation between one or more unions and an employer or employers' organisation(s). The outcome is a collective agreement that defines terms of employment - typically wages, working hours and in-work benefits. The agreement affords labour protection: minimum wages, regular earnings; limits on working hours and predictable work schedules; safe working environments; parental leave and sick leave; and a fair share in the benefits of increased productivity. The International Labour Organization (ILO) Collective Agreements Recommendation 1951 (No. 91) considers, where appropriate and having regard to national practice, that measures should be taken to extend the application of all or some provisions of a collective agreement to all employers and workers included wthin the domain of the agreement. The extension of a collective agreement generalises the terms and conditions of employment, agreed between organised firms and workers, represented through their association(s) and union(s), to the non-organised firms within a sector, occupation or territory. The collection of chapters in this volume are about the extension of collective agreements as an act of public policy.
