Enhanced Cooperation and European Tax Law

Enhanced Cooperation and European Tax Law PDF Author: Caroline Heber
Publisher: Oxford University Press
ISBN: 0192653334
Category : Law
Languages : en
Pages : 545

Book Description
The enhanced cooperation mechanism allows at least nine Member States to introduce secondary EU law which is only binding among these Member States. From an internal market perspective, enhanced cooperation laws are unique as they lie somewhere between unilateral Member State laws and uniform European Union law. The law creates harmonisation and coordination between the participating Member States, but may introduce trade obstacles in relation to non-participating Member States. This book reveals that the enhanced cooperation mechanism allows Member States to protect their harmonised values and coordination endeavours against market efficiency. Values which may not be able to justify single Member State's trade obstacles may outweigh pure internal market needs if an entire group of Member States finds these value worthy of protection. However, protection of the harmonised values can never go as far as shielding participating Member States from the negative effects of enhanced cooperation laws. The hybrid nature of enhanced cooperation laws - their nexus between the law of a single Member State and secondary EU law - also demands that these laws comply with state aid law. This book shows how the European state aid law provisions should be applied to enhanced cooperation laws. Furthermore, the book also develops a sophisticated approach to the limits non-participating Member States face in ensuring that their actions do not impede the implementation of enhanced cooperation between the participating Member States.

Traditional Justice and Reconciliation After Violent Conflict

Traditional Justice and Reconciliation After Violent Conflict PDF Author: Lucien Huyse
Publisher: International IDEA
ISBN: 9789185724284
Category : Burundi
Languages : en
Pages : 0

Book Description
This book presents the findings of a major comparative study examining the role played by traditional justice mechanisms in dealing with the legacy of violent conflict in Africa. It focuses on case studies of five countries -- Rwanda, Mozambique, Uganda, Sierra Leone and Burundi - that are used as the basis for outlining conclusions and options for future policy development in the related areas of post-conflict reconstruction, democracy building and development. "Traditional Justice & Reconciliation After Violent Conflict" suggests that in some circumstances traditional mechanisms can effectively complement conventional judicial systems and represent a real potential for promoting justice, reconciliation and a culture of democracy. At the same time it cautions against unrealistic expectations of traditional structures and offers a sober, evidence-based assessment of both the strengths and the weaknesses of traditional conflict management mechanisms within the broader framework of post-conflict social reconstruction efforts. The book is intended to serve both as a general knowledge resource and as a practitioner's guide for national bodies seeking to employ traditional justice mechanisms, as well as external agencies aiming to support such processes.

Bridges for Development

Bridges for Development PDF Author: Robert Devlin
Publisher: IDB
ISBN: 9781931003308
Category : Business & Economics
Languages : en
Pages : 268

Book Description
Latin America has been pursuing intense structural reforms since the mid-1980s. The reforms have been a primary instrument for achieving the development goals of stable and higher rates of economic growth, more social equity, and a solid democratic setting. The region has advanced on all three fronts, but much more needs to be done. Bridges for Development explores options to strengthen policies and institutions for deepening structural reforms in all areas of development through trade and integration. Making advances in these areas is critical because the multilateral negotiations in the Doha Development Round are contingent on the complex dynamics of worldwide consensus -- and Latin America's capacity to adequately represent its interests in terms of determining the direction of unilateral policy and regional initiatives. However, as the book points out, it might be said that the easystages of unilateral trade and regional integration are over; the next steps toward consolidation will require countries to redouble their political will to confront difficult challenges as well as to refine policies, build stronger institutional structures to support them, and work better with civil society. The wave of market opening and regionalism in the 1990s has provided new opportunities in these areas.

The Routledge Handbook of Language Revitalization

The Routledge Handbook of Language Revitalization PDF Author: Leanne Hinton
Publisher: Routledge
ISBN: 1317200853
Category : Language Arts & Disciplines
Languages : en
Pages : 681

Book Description
The Routledge Handbook of Language Revitalization is the first comprehensive overview of the language revitalization movement, from the Arctic to the Amazon and across continents. Featuring 47 contributions from a global range of top scholars in the field, the handbook is divided into two parts, the first of which expands on language revitalization issues of theory and practice while the second covers regional perspectives in an effort to globalize and decolonize the field. The collection examines critical issues in language revitalization, including: language rights, language and well-being, and language policy; language in educational institutions and in the home; new methodologies and venues for language learning; and the roles of documentation, literacies, and the internet. The volume also contains chapters on the kinds of language that are less often researched such as the revitalization of music, of whistled languages and sign languages, and how languages change when they are being revitalized. The Routledge Handbook of Language Revitalization is the ideal resource for graduate students and researchers working in linguistic anthropology and language revitalization and endangerment.
