Practical Social Work Law

Practical Social Work Law PDF Author: Siobhan E. Laird
Publisher: Routledge
ISBN: 1317864689
Category : Social Science
Languages : en
Pages : 577

Book Description
Practical Social Work Law: analysing court cases and inquiries presents legal issues associated with social work in an accessible format. It approaches the law in a way that is less daunting and more engaging by examining actual court cases and public inquiries, and explores the stories of real people and the legal and ethical dilemmas practitioners will face. The text adopts a problem-centred approach to learning by introducing the reader to key aspects of the law through a series of real-life situations; it addresses basic principles regarding the operation of the law and explores the lessons for good practice. Each chapter addresses a specific area of social work law including family breakdown, safeguarding children, youth justice, adults with disabilities, mental health and mental capacity. Landmark cases, cases drawn from the lower courts, tribunals, and ombudsman’s decisions are included throughout presenting an accessible account of the application of the law. Practical Social Work Law is an essential text for undergraduate, postgraduate and recently qualified social workers who are wrestling with the complexity of the law and the professional dilemmas it poses for their practice. "This book is unusual for a law book in that it is not only a reference book but also a very readable volume...[It] is set out clearly and provides a sound basis for student social workers new to the law and a refresher for qualified practitioners." Catherine Poulter. RSW. Integrated Community Services. Carmarthenshire County Council

Category : Social Science
Languages : en
Pages : 429

Book Description
"This is the first book to give social workers the tools to understand their clients' legal needs and rights and to address them collaboratively and effectively. Lyn Slater and Kara Finck ground their text in a comprehensive grasp of the legal system and the inequities of race, class, and gender that shape clients' experiences. Social Work Practice and the Law is a powerful call for social workers to be passionate and skillful advocates for their clients. Essential reading for social workers and lawyers alike who serve low-income people entangled in systems that so often fail them." Dorothy Roberts, JD Kirkland & Ellis Professor, Northwestern University School of Law Author, Shattered Bonds: The Color of Child Welfare Based on the author's innovative and nationally recognized prototype for inter-professional work at Fordham University, this is the only volume about social work and the legal system that is written from the social worker's perspective. Devoid of "legalese," the book is designed to help social workers develop the ability to reappraise, question, and challenge the law to best serve their clients. It aims to promote the development of a more strategic relationship with the legal system-a partnership that can achieve more creative and just solutions to social problems. Exhaustive in scope, Social Work and the Law identifies current national and international trends and legal movements that support and invite inter-professional, critically competent social work participation. The book also identifies and explains the essential knowledge, skills, values, and attitudes necessary for the attainment of collaborative critical competence when interacting with the legal system. Each chapter includes vivid case studies based on actual collaborations that illustrate the application of theory to practice. Chapters also include legal, social work, and evidence-based resources. Key Features: Promotes a proactive approach to the ways in which social workers can use law to promote clients' best interests Addresses all domains of social work practice-child welfare, housing law, educational access, disability law, benefits, and more Offers abundant case studies taken from the authors' real-life work Devoid of "legalese" and written from a social worker's perspective

Protecting the Social Service Client

Protecting the Social Service Client PDF Author: Joel F. Handler
Publisher: Academic Press
ISBN: 1483260267
Category : Law
Languages : en
Pages : 177

Book Description
Protecting the Social Service Client: Legal and Structural Controls on Official Discretion examines the treatment of clients of public and private social service agencies and highlights the role of consumer protection in dealing with the existence and abuse of administrative discretion. Of particular concern is the legal rights of these social service clients — principally the poor — and how effectively these rights are being enforced. The history of due process protection (that is, by means of appeals and court hearings) is discussed and a number of legal and structural remedies are offered. Comprised of six chapters, this book begins by setting forth the issues and reviewing the experiences of client protections under the due process model, with emphasis on discretion as a key legal issue in social services. The reader is then introduced to legal theory, particularly how constitutional and statutory law defines the legal interests of social service clients and what system of protection is provided by the law. Subsequent chapters focus on the protection of client rights in practice as well as several different legal and structural remedies to client protections. The legal protection of clients is analyzed, first from the client perspective and then from the point of view of the policymaker. This monograph is intended for social work professionals, administrators, policymakers, and advocates of the rights of people who deal with social welfare agencies.
