This Bill follows on from the Government's recent publication of its white paper, Protecting the Public: strengthening protection against sex offenders and reforming the law on sexual offences (Cm 5668, ISBN 0101566824) in 2002. The Bill is in 3 parts, in part 1 new provision regarding sexual offences is laid out, part 2 contains measures for protecting the public from sexual offending, and in part 3 there are general provisions relating to the Bill. New offences include sexual "grooming" of children which allows police to intervene and arrest a suspect before any sexual activity takes place, also new offences relating to sexual exploitation (including prostitution and pornography) to protect children up to age 18. There is more protection for people with learning disabilities or mental disorder. UK sex offenders will have to re-register annually instead of every five years and overseas sex offenders will now have to register on arrival in the UK. The law on consent in regard to rape is clarified, whilst "date rape" is not made a separate offence but using drugs or other substances to commit a sexual offence will carry a 10 year sentence. This Bill is the most radical reform of sex offences legislation in 50 years.
