The United States, with its complex regulatory system, has one of the highest rates of occupational fatality in the developed world, and deteriorating working conditions more generally. Why, after a century of reform, are U.S. workers growing less safe and secure? Comparing U.S. regulatory practices to their European and Latin American counterparts, Root-Cause Regulation provides insight into the causes of this downward trend and ways to reverse it, offering lessons for rich and poor countries alike. The United States assigns responsibility for wages and hours, collective bargaining, occupational safety, and the like to various regulatory agencies. In France, Spain, and their former colonies, a single agency regulates all firms. The U.S. model was designed for the inspection of mass production enterprises by inflexible specialists and is ill-suited to the decentralized and destabilized employment of today. In the Franco-Iberian system, by contrast, the holistic perspective of multitasking generalists illuminates the root causes of noncompliance—which often lie in outdated techniques and technologies—and offers flexibility to tailor enforcement to different firms and market conditions. The organization of regulatory agencies thus represents a powerful tool. Getting it right, the authors argue, makes regulation not the job-killer of neoliberal theory but a generative force for both workers and employers.

The Omnibus Reconciliation Act of 1987 (OBRA), brought much needed regulation to the nursing home industry. Since enacting OBRA, nursing homes have demonstrated some improved outcomes yet 25-years of evidence indicates that the OBRA legislation has not systemically improved the standard of care received by residents. Furthermore, the federal agency responsible for monitoring nursing home compliance, the Center for Medicare and Medicaid Services (CMS), has sponsored a number of subsequent quality initiatives but has been unable to affect sustained improvement, even in those deemed the nation's worst facilities. Heralded as the most comprehensive legislation since OBRA for improving nursing home care, the Affordable Care Act (ACA) contains provisions designed specifically to address failings in the existing quality compliance mechanisms. While the ACA mandates have the appearance of offering solutions to endemic quality problems, so too have previous, and ultimately unsuccessful initiatives, suggesting that in those efforts, causal weakness were not addressed. Given the pressing need to improve nursing home quality, it is essential to pinpoint and remediate the elements that have contributed to the history of regulatory failure. Through an examination of the regulatory culture of the industry and the application of root cause analysis tools, this study explores the systems that have fostered the industry's less than optimal status quo, identifying pervasive, contributing factors in the failed implementation and oversight of nursing home quality initiatives since OBRA. Based on the findings from the analysis, this paper establishes that challenges and barriers regarding compliance with ACA nursing home quality requirements will continue to arise until the underlying root causes are addressed in a meaningful manner. In the United States, some populations suffer from far greater disparities in health than others. Those disparities are caused not only by fundamental differences in health status across segments of the population, but also because of inequities in factors that impact health status, so-called determinants of health. This work argues that current cryptocurrency regulation, particularly in the areas of enforcement and compliance, is inadequate. It proposes reflexive regulation as an alternative approach. This book provides strategies for a reflexive regulation approach to cryptocurrencies, developed through the identification of the internal self-regulatory mechanisms of the cryptocurrency system. Apportioning blame for current problems to the regulators’ failure to take into account the inherent technical features of cryptocurrencies, the work promotes reflexive regulation in which the law acts at a subsystem-specific level to install, correct, and redefine democratic self-regulatory mechanisms. It provides strategies for this approach, developed through the identification of the internal self-regulatory mechanisms of the cryptocurrency system. These are identified as imbedded in the technical functionality of computer code and consensus-based distributive governance mechanisms respectively. In addition to providing a technical, historical and legal overview of cryptocurrencies, the book concludes by providing recommendations aimed at redirecting code and consensus towards achieving regulatory goals.
