El denominado «caso Prestige» ofrece una muestra extrema de las dificultades de la reparación de los daños ambientales; no sólo en el plano físico, por lo común imposible de regenerar o restituir a su estado primitivo, sino también en el jurídico. Según expone con acierto en esta obra el autor, la reparación en términos jurídicos depende de un concepto clave: el responsable. Si no hay responsable jurídico, no hay reparación. Es el que debe afrontar todas las consecuencias asociadas al daño. A la inversa, si hay tal responsable, también lo será de la reparación. La responsabilidad se ha determinado, en el caso que nos ocupa, por la vía penal. En última instancia, el Tribunal Supremo ha establecido que existen unos responsables a título de delito que, por consiguiente, deben asumir las responsabilidades civiles por los daños producidos. Esta secuencia se desarrolla por el autor con brillantez en el axioma de que los responsables del delito también lo son de los daños producidos con ocasión de su comisión. Sin embargo, hay cuatro elementos que la obra tiene en cuenta como referentes ineludibles: el marco institucional en el que la depuración de las responsabilidades se ha de producir; cómo se reparan, en términos jurídicos, los daños, o sea, cómo se exige la responsabilidad civil; la cobertura en términos de responsabilidad civil, que a los responsables les dispensa el contrato de seguro y en último lugar, la acción directa con la que, en nuestro Derecho, cuentan los dañados para dirigirse contra el asegurador buscando la reparación de los daños.
