Excerpt from Report of the Employers' Liability and Workmen's Compensation Commission of the State of Michigan Under the doctrine of assumed risk, an employe is held to assume and consent to the ordinary and obvious risk incident to his employ ment, and if he is injured thereby, as a result of these risks, he cannot recover. It has been argued in this respect that the employe practically can not refuse to work at a hazardous task, and is thus compelled to assume the risk. The Michigan courts have not applied this rule with as much rigor as have some other courts. They have held that an employe as sumes no risk which he is incapable of appreciating, and that where there is a doubt as to the safety of the machinery, the employe can rely upon the assurance of the master. But, nevertheless, earnest eriti cism has been made of the doctrine as inapplicable to present conditions when workmen are not entirely free to select their employment. Excerpt from Workmen's Compensation Law of the State of Michigan: Revised August, 1915, With Amendments and Supplementary Acts Section 5. If the employer, or the insurance company carrying such risk, or commissioner of insurance, as the case may be, and the injured employee reach an agreement in regard to compensation under this act, a memorandum of such agreement shall be filed with the industrial accident board, and, if approved by it, shall be deemed final and binding upon the parties thereto. Such agreements shall be approved by said board only when the terms conform to the provisions of this act. Section 6. If the employer, or the insurance company carrying such risk, or the commissioner of insurance, as the case may be, and the employee fail to reach an agreement in regard to compensation under this act, either party may notify the industrial accident board, who shall thereupon call for the formation of a committee of arbitration. The committee of arbitration shall consist of three members, one of whom shall be a member of the industrial accident board, and shall act as chairman.
