Este libro realiza un estudio pormenorizado del régimen jurídico de los suelos contaminados, analizando la regulación establecida en la Unión Europea, la República Federal de Alemania, el Estado español y distintas comunidades autónomas, como son Cataluña, el País Vasco y Galicia. Se analizan de forma exhaustiva los distintos aspectos objeto de regulación en este ámbito, prestando especial atención al régimen de responsabilidad. Se ponen de relieve los principales problemas surgidos en torno a esta materia y se profundiza en el régimen jurídico establecido y en las soluciones aportadas, desde una perspectiva crítica. Los suelos contaminados han sido un tema pendiente para el derecho ambiental durante muchos años. En la actualidad, fruto de la afloración de muchos de ellos, se ha evidenciado la necesidad de afrontar esta importante problemática ambiental y se ha empezado a regular sobre la materia para lograr la reparación de estos suelos que se han contaminado, e incluso proteger y prevenir la contaminación del recurso suelo, como se ha hecho desde hace años con otros recursos. Debido a la novedosa y compleja regulación, son pocos los autores que se han dedicado a su estudio, con lo que esta obra representa una gran aportación, en tanto que se detiene en el análisis del régimen jurídico de estos suelos. Además no tan solo lo hace desde la perspectiva del derecho positivo vigente en el Estado, sino también teniendo en cuenta las propuestas que aún no han sido aprobadas, tanto en el ámbito de la Unión Europea, como incluso en el propio Estado, así como la regulación establecida en Estados más avanzados que han afrontado con anterioridad la problemática, como es Alemania. También incorpora un análisis jurisprudencial de la materia, de gran interés, ya que, si bien la jurisprudencia sobre la materia tampoco es numerosa en el Estado español, sí lo es, en cambio, en Alemania. La obra incluye además esquemas para hacer más comprensible la materia, así como una tabla de equivalencias entre normas.
