Il concetto di riparazione del danno cagionato, espresso in termini anche diversi nelle varie fattispecie a rilevanza 231 che sono trattate nel presente lavoro consente di riannodare i fili fra modello di organizzazione, gestione e controllo dell’ente, sistema di gestione ambientale (SGA) e le attività di compliance. Solo con l’attività di riparazione del danno e con la spinta da parte della societas verso questo tipo di approccio l’attività di impresa nel suo insieme può dirsi sostenibile. Perché se un reato è stato commesso e se il Modello non è stato in grado di prevenire eventi dello stesso tipo di quello che si è verificato, oltre al rafforzamento delle regole di compliance, oltre alle modifiche migliorative del MOGC è necessario attuare un sistema 231 maggiormente orientato in senso riparatorio che possa ricucire lo “strappo” cagionato all’ambiente dalla commissione del reato.
