A Re-definition of Belonging? PDF Author: Ricky van Oers
Publisher: BRILL
ISBN: 904742851X
Category : Law
Languages : en
Pages : 356

Book Description
Language and integration tests as a condition for naturalisation and various types of legal residence permits are topical issues in several European Member States. The introduction of the tests reflects a change in ideas on the relationship between legal status and integration. Since the introduction of the tests is a rather recent development, little is known of the effects of the formalised testing schemes. Whether the tests have in fact contributed to the integration of immigrants in the host society or whether they function as a mechanism for selection and exclusion is unknown. In this book, experts from Austria, Belgium, Denmark, France, Germany, Hungary, Latvia, the Netherlands and the United Kingdom analyse the policies concerning the integration of newcomers and/or future citizens in their countries.

Law and Judicial Dialogue on the Return of Irregular Migrants from the European Union

Law and Judicial Dialogue on the Return of Irregular Migrants from the European Union PDF Author: Madalina Moraru
Publisher: Bloomsbury Publishing
ISBN: 1509922962
Category : Law
Languages : en
Pages : 543

Book Description
This volume examines the implementation of the Return Directive from the perspective of judicial dialogue. While the role of judges has been widely addressed in European asylum law and EU law more generally, their role in EU return policy has hitherto remained under explored. This volume addresses the interaction and dialogue between domestic judiciaries and European courts in the implementation of European return policy. The book brings together leading authors from various backgrounds, including legal scholars, judges and practitioners. This allows the collection to offer theoretical and practical perspectives on important questions regarding the regulation of irregular migration in Europe, such as: what constitutes inadequate implementation of the Directive and under which conditions can judicial dialogue solve it? How can judges ensure that the right balance is struck between effective return procedures and fundamental rights? Why do we see different patterns of judicial dialogue in the Member States when it comes to particular questions of return policy, for example regarding the use of detention? These questions are more timely than ever given the shifting public discourse on immigration and the growing political backlash against immigration courts. This book will be essential reading for all scholars and practitioners in the fields of immigration law and policy, EU law and public law.

Nowhere Countries: Exclusion of Non-Citizens from Rights through Extra-Territoriality at Home

Nowhere Countries: Exclusion of Non-Citizens from Rights through Extra-Territoriality at Home PDF Author: Pauline Maillet
Publisher: BRILL
ISBN: 9004383506
Category : Law
Languages : en
Pages : 312

Book Description
In Nowhere Countries: Exclusion of Non-Citizens from Rights through Extra-Territoriality at Home, Pauline Maillet offers a new theoretical framework to understand the mechanisms by which non-citizens are excluded from the rights attached to sovereign territory when arriving at states’ borders. Initiated in Charles de Gaulle airport, the analysis encompasses similar cases in countries other than France. This interdisciplinary study traces how some liberal democracies create spaces construed as extra-territorial on their own soil to circumvent obligations owed to sea or airborne asylum seekers under the Refugee Convention and its Protocol. How do states make their territory vanish to prevent asylum seekers’ arrival? Using a combination of legal analysis and ethnography, this book identifies the legal techniques, enforcement practices and mental landscapes that have sustained nowhere countries.

Africa and France

Africa and France PDF Author: Dominic Thomas
Publisher: Indiana University Press
ISBN: 0253007038
Category : Political Science
Languages : en
Pages : 445

Book Description
An “excellent [and] incisive” look at identity, immigration, and culture in postcolonial France (Journal of West African History). This stimulating and insightful book reveals how increased control over immigration has changed cultural and social production in theater, literature, and even museum construction. Dominic Thomas’s analysis unravels the complex cultural and political realities of long-standing mobility between Africa and Europe. Thomas questions the attempt to place strict limits on what it means to be French or European and offers a sense of what must happen to bring about a renewed sense of integration and global Frenchness. “Essential reading for anyone investigating the debates surrounding contemporary French identity and the ever-changing relationship between France and her former colonial possessions.” —African Studies Bulletin

REGINE - Regularisations in Europe

REGINE - Regularisations in Europe PDF Author: Martin Baldwin-Edwards
Publisher: Amsterdam University Press
ISBN: 9085550084
Category : Law
Languages : en
Pages : 576

Book Description
REGINE is a research project on regularisation practices in the European Union. The aim of the project is to provide a thorough mapping of practices relating to the regularisation of third country nationals illegally resident in EU Member States. Two additional non-EU countries - Switzerland and the US - will also be covered to gain insights in regularisation practices and the impact of regularisations elsewhere. In examining regularisation practices, the project also investigates the relationship of regularisation policies to the overall migration policy framework, including to protection issues and refugee policies. Moreover, the project examines the political position of different stakeholders towards regularisation policies on the national level. Finally, the project examines potential options for policies on regularisation on the European level, incorporating Member States as well as other stakeholders' views on possible instruments on the European level.

Yearbook of the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment/Annuaire de la convention européenne pour la prévention de la torture et des peines ou traitements inhumains ou dégradants

Yearbook of the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment/Annuaire de la convention européenne pour la prévention de la torture et des peines ou traitements inhumains ou dégradants PDF Author: Council of Europe/Conseil de l'Europe
Publisher: BRILL
ISBN: 9004338926
Category : Law
Languages : en
Pages : 2325

Book Description
The European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment was adopted by the Committee of Ministers of the Council of Europe in June 1987. It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention. The Convention is intended to be an integrated part of the Council of Europe system for the protection of human rights, placing a proactive non-judicial mechanism alongside the reactive judicial mechanism established under the ECHR. The Yearbook of the European Convention for the Prevention of Torture offers an essential annual overview of developments in relation to the ECPT. Part One contains general information. Part Two is about the European Committee for the prevention of torture and inhuman or degrading treatment or punishment (CPT). Part Three is a general report on the activities of the European Committee for the prevention of torture and inhuman or degrading treatment or punishment. Part Four contains reports on visits by the European Committee for the prevention of torture and inhuman or degrading treatment or punishment and responses of governments. Bilingual: English and French; 2-volume set.

Le statut juridique des migrants admis à des fins d'emploi

Le statut juridique des migrants admis à des fins d'emploi PDF Author: Ryszard Cholewinski
Publisher: Council of Europe
ISBN: 9789287154088
Category : Alien labor
Languages : fr
Pages : 104

Book Description
