El trabajo arqueológico obedece a pautas metodológicas precisas, a criterios científicos que persiguen el incremento del conocimiento; ello nada tiene que ver con los saqueadores, pero tampoco con la actividad de quienes circulan por ahí buscando en sus ratos libres objetos sueltos con los que completar una colección particular que a su muerte donarán desinteresadamente a un museo local. Esta no es sólo la opinión de los autores del presente libro, sino que es la del legislador. Es verdad que las leyes parten de este presupuesto desde hace bastante tiempo, pero ha sido a raíz de la del Patrimonio Histórico Español de 1985, fecundamente secundada por las aprobadas por las comunidades autónomas, cuando el mismo ha recibido un potente e inequívoco espaldarazo normativo llamado a desterrar definitivamente del concepto de Arqueología cualquier intervención que se no se ajuste a criterios científicos y a reservar el régimen jurídico del patrimonio arqueológico a los frutos de dicha actividad. De esta forma, dos ramas del saber muy distintas entre sí, la Arqueología y el Derecho, contribuyen cada una a su manera y con sus respectivos instrumentos a racionalizar y ordenar una materia cuya importancia trasciende de la satisfacción personal pues se inscribe en el plano de lo social. Un patrimonio que está llamado en última instancia, tras haber sido documentado y estudiado, a ser objeto de fruición colectiva, a ser conocido y comprendido por la ciudadanía, que tiene derecho a acceder a él y a conocer su significado. El objetivo del presente libro es explicar, en términos escuetos y sencillos, los fundamentos científicos de la Arqueología y de la investigación arqueológica, por un lado, y los aspectos más elementales del régimen jurídico del patrimonio arqueológico, por otro. Sus evidentes límites estructurales han obligado a dejar aparcado el tratamiento de muchos aspectos que los autores consideran relevantes desde su respectiva especialidad, en beneficio de una exposición didáctica y circunscrita a lo esencial en el sentido más estricto de la palabra.

El ámbito de los bienes arqueológicos se encuentra en la actualidad, y desde un punto de vista jurídico, intensamente intervenido. Dieciocho leyes regulan el Patrimonio Cultural en nuestro país y un número elevado de normas (sobre delitos, ordenación del territorio, mecenazgo, urbanismo, propiedad, organización administrativa, Patrimonio Natural) inciden de manera significativa en su régimen jurídico. Dicho de otra forma: en ningún momento de nuestra historia han existido tantas normas con la finalidad de proteger y fomentar el mantenimiento y la conservación del Patrimonio Arqueológico ni un marco jurídico tan favorable, al menos teóricamente, para preservar los elementos de nuestro pasado. Sin embargo, en los medios de comunicación siguen apareciendo, de manera constante, noticias sobre atropellos contra la integridad de estos bienes y a los tribunales continúan llegando casos que ponen al descubierto los puntos débiles del sistema. Objetivos El objetivo de esta tesis es analizar el actual régimen jurídico sancionador de los bienes arqueológicos y conocer cuáles son las herramientas jurídicas que tenemos a nuestro alcance, desde el ámbito del Derecho administrativo, para reaccionar cuando se realizan actividades dañinas contra bienes. Se trata, por consiguiente, de indagar en los instrumentos que nuestro ordenamiento jurídico recoge, con los que hacer frente a las actuaciones ilícitas contra el Patrimonio Arqueológico, y proponer medidas que acrecienten su protección. Many new and fruitful avenues of investigation open up when scholars consider forgery as a creative act rather than a crime. We invited authors to contribute work without imposing any restrictions beyond a willingness to consider new approaches to the subject of ancient fakes, forgeries, and questions of authenticity. The result is this volume, in which our aim is to display some of the many possibilities available to scholarship. The exposure of fraud and the pursuit of truth may still be valid scholarly goals, but they implicitly demand that we confront the status of any text as a focal point for matters of belief and conviction. Recent approaches to forgery have begun to ask new questions, some intended purely for the sake of debate: Ought we to consider any author to have some inherent authenticity that precludes the possibility of a forger's successful parody? If every fake text has a real context, what can be learned about the cultural circumstances which give rise to forgeries? If every real text can potentially engender a parallel history of fakes, what can this alternative narrative teach us? But fabula docet: The falsum does not simply make the great, annoying stone before the door of the truth (otherwise this here would really be a "council of antiquarians and paleographers"). How do children construct, negotiate and organize space? The study of social space in any human group is fraught with limitations, and to these we must add the further limits involved in the study of childhood. Here specialists from archaeology, history, literature, architecture, didactics, museology and anthropology build a body of theoretical and methodological approaches about how space is articulated and organized around children and how this disposition affects the creation and maintenance of social identities. Children are considered as the main actors in historic dynamics of social change, from prehistory to the present day. Notions on space, childhood and the construction of both the individual and the group identity of children are considered as a prelude to papers that focus on analyzing and identifying the spaces which contribute to the construction of children’s identity during their lives: the places they live, learn, socialize and play. A final section deals with these same aspects, but focuses on funerary contexts, in which children may lose their capacity to influence events, as it is adults who establish burial strategies and practices. In each case authors ask questions such as: how do adults construct spaces for children? How do children manage their own spaces? How do people (adults and children) build (invisible and/or physical) boundaries and spaces?
