Le droit d’accès général à l’information dans l’Union européenne constitue l’élément central du principe de transparence qui s’est imposé ces dernières années pour qualifier le mouvement d’ouverture de l’administration dans les États membres. Mais le droit d’accès à l’information, et donc la transparence, sont aussi, depuis le Traité sur l’Union européenne, au centre de la construction européenne, permettant la démocratisation du processus décisionnel des institutions communautaires. La reconnaissance d’un droit d’accès à l’information au citoyen est à la base d’une profonde modification dans le fonctionnement de l’administration publique permettant une participation active du citoyen. Le droit d’accès à l’information peut être distingué en deux pôles . D’une part, le droit d’accès général à l’information qui se caractérise par le droit d’accès général aux documents administratifs et, d’autre part, par le droit d’accès personnel à l’information qui se réalise à travers la participation de l’administré à la procédure administrative ainsi qu’à travers l’accès aux données à caractère personnel. Des différences importantes existent cependant entre les différents États membres. L’analyse des systèmes français, allemand, italien (et d’autres) du droit d’accès à l’information applicable aux institutions communautaires permet de constater que chaque système juridique a une conception particulière du droit d’accès à l’information. Cela dit, grâce au droit communautaire, nous assistons à une certaine harmonisation du droit d’accès à l’information dans des domaines spécifiques, comme c’est le cas pour le droit d’accès à l’information relatif à l’environnement ainsi que pour le droit d’accès à l’information dans le cas de la protection des données à caractère personnel. Enfin, l’évolution va dans le sens d’une reconnaissance constitutionnelle du droit d’accès à l’information, le rattachant ainsi directement au principe de l’État de droit.
