La quasi-totalité des pays d'Afrique francophone subsaharienne sont aujourd'hui engagés dans un processus d'élaboration d'un acte uniforme relatif au droit du travail dans le cadre de l'Organisation pour l'Harmonisation en Afrique du Droit des Affaires (OHADA). Face à cette occasion historique, il est apparu pertinent de mener une analyse sur les droits positifs de certains Etats parties au Traité OHADA afin de faire des suggestions éventuelles sur les adaptations à opérer. A cet égard, l'analyse a révélé que les droits positifs des pays étudiés souffrent d'une grande ineffectivité due notamment à la résistance de certaines coutumes locales et à l'exclusion de leur champ d'application de la masse des travailleurs de l'économie informelle. Ainsi, s'est posée la question de la pertinence des normes vis-à-vis des réalités locales auxquelles elles sont censées s'appliquer. S'il faut se garder de tomber dans ce qu'il convient d'appeler le mythe de l'adaptation du droit au fait, force est d'admettre que la question se pose avec acuité. L'adaptation du droit au travail africain ne pourrait, bien évidemment, se cantonner à une prise en compte des seules situations locales. Elle s'étend également à la prise en compte des règles du jeu de la mondialisation contemporaine laquelle doit être universellement humanisée par les principes et droits fondamentaux au travail tels que définis par l'Organisation internationale du Travail (OIT).
