La composante environnementale du développement durable s’est imposée comme une notion incontournable, un enjeux majeur qui s’est peu à peu immiscé dans la sphère commerciale. Le commerce international ne pouvait plus ignorer cette notion de protection de l’environnement et doit désormais composer avec. Ces deux ordres juridiques distincts entretiennent des relations conflictuelles, leur relation s’apparente à deux asymptotes qui tendent l’une vers l’autre sans jamais se rejoindre totalement, car leurs intérêts sont divergents. La protection de l’environnement en croisant le chemin du libre échange peut avoir une incidence sur ce dernier notamment en le restreignant. Ainsi de prime abord, cette relation houleuse pourrait aboutir à des conflits potentiels d’ordres normatifs, juridictionnels ou de solutions. Les normes édictées par les AME sont pour certaines en contradiction avec celles érigées par le système commercial multilatéral. Sur le plan de la compétitivité, la mise en oeuvre d’une politique environnementale rigoureuse pourrait avoir pour effet de diminuer la compétitivité des Etats développés ou de leurs entreprises face à ceux qui sont plus laxistes en matière environnementale. Cependant, on constatera que l’environnement peut être facteur de compétitivité. Par ailleurs, afin de compenser des distorsions de concurrence, des mesures compensatoires pourraient être envisagées, comme un ajustement de taxe aux frontières. La sphère commerciale a néanmoins fait des efforts quant à la problématique environnementale. Dans le cadre de l’OMC, la jurisprudence s’est peu à peu ouverte à cette question et admet, certes de manière conditionnée, qu’un Etat puisse au nom de la préservation de l’environnement restreindre ses échanges. La création d’un Comité sur le commerce et l’environnement démontre sa volonté de ne pas ignorer les questions environnementales. Cette volonté s’est inscrite également dans le cadre des nouveaux ACR qui ont pour objectifs d’aller plus loin que le système commercial multilatéral en intégrant au sein de leur dispositions les questions exclues lors des négociations de Cancun, telles que l’environnement. Les évaluations environnementales des politiques commerciales représentent également un instrument novateur au service de l’environnement. La mise en oeuvre d’éco-étiquetage ou la création de biens et de services environnementaux témoignent de l’impact grandissant qu’a la composante environnementale au sein du libre échange.
