The book provides an overview of how international law is today constructed through diverse macro and microprocesses that expand its traditional subjects and sources, with the attribution of sovereign capacity and power to the international plane (moving the international toward the national). Simultaneously, national laws approximate laws of other nations (moving among nations or moving the national toward the international) and new sources of legal norms emerge, independent of states and international organisations. This expansion occurs in many subject areas, with specific structures: commercial, environmental, human rights, humanitarian, financial, criminal and labor law contribute to the formation of post national law with different modes of functioning, different actors and different sources of law that should be understood as a new complexity of law.

Le droit de l’environnement est en pleine mutation, tout comme les règles applicables à la protection des animaux. La multiplicité des enjeux que tous deux sous-tendent invite le législateur et les juges à renouveler leur regard. Lier l’ensemble présente cependant une difficulté : alors que leurs champs respectifs paraissent a priori se croiser, le droit de l’environnement ne rassemble pas la totalité des dispositions destinées à encadrer, sinon la prise en compte du bien-être des animaux, du moins la protection qui leur est dévolue. The African Convention on the conservation of nature and natural resources was adopted in 1968 in Algiers. Considered the most forward looking regional agreement of the time, it influenced significantly the development of environmental law in Africa. Two and a half decades of intense developments in international environmental law made it necessary to revise this treaty, update its provisions and enlarge its scope. This was undertaken under the auspices of the African Union (previously OAU), and the revision was adopted by its Heads of State and Government in July 2003 in Maputo. The introduction provides an overview of this new international treaty, as well as a commentary to each of its provisions.
