La doctrine fiscale moderne semble concentrer son attention sur les rapports qu'entretiennent les contribuables avec l'impôt et avec l'administration. Peu nombreux sont ceux qui s'interrogent sur les liens qui unissent le phénomène fiscal à son juge. Si la juridiction fiscale a parfois constitué un objet d'études, ce n'est qu'avec beaucoup de précautions qu'est abordée la question de l'apport de la jurisprudence en la matière.
