Il m'a paru intéressant de le publier même plusieurs années après alors que le système a évolué car il retrace le contexte juridique de l'époque. C'est dans cet espace temps que ce situe l'étude de ce projet qui devait devenir la seconde loi française contre le dopage, la loi du 28 juin 1989. L'une de ses particularités principales a été de dépénaliser le dopage, devenue depuis lors pour les sportifs licenciés principalement une infraction sportive disciplinaire, de nature administrative. Elle a relégué l'infraction pénale aux cas où le licencié sportif est pourvoyeur, aux cas de trafic de produits, médicaments ou drogues, et d'usage de stupéfiants. L'autre particularité majeure de cette loi de 1989 est d'avoir créé une autorité administrative dédiée à la lutte contre le dopage, le Conseil de Prévention et de lutte contre le dopage (C.P.L.D.) devenu ensuite l'Agence Française de Lutte contre le Dopage (A.F.L.D.).
