Las disputas en tomo al reconocimiento y pleno ejercicio de los derechos de los pueblos indígenas sobre sus tierras, han sido históricamente transversales a las relaciones entre estas poblaciones, el Estado y el resto de la sociedad colon1biana. Si bien hoy, tras un largo proceso de reivindicaciones, los pueblos indígenas cuentan con un 1narco normativo y jurisprudencial nacional e internacional que reconoce estos derechos; tales disputas, y en particular aquellas por el control y ad1ninistración de la tierra y sus recursos naturales, vienen en un incremento proporcional al decidido avance de un modelo de desarrollo sustentado en gran 1nedida en la explotación y aprovechamiento de estos recursos. La investigación cuyos resultados presenta este texto se planteó caracterizar las disputas configuradas y desarrolladas en el marco del ordenamiento jurídico e institucional de la Constitución Política de 1991, que han llevado a la existencia de una brecha entre el reconocimiento de los derechos territoriales de los pueblos indígenas y su eficacia en Colombia. En cuatro capítulos está caracterización se presenta partiendo de una aproximación a los antecedentes históricos de estas disputas y su expresión en el derecho nacional e internacional, y luego, a través de un análisis crítico en el que se aborda su posterior configuración en el marco de la vigencia del actual ordenamiento constitucional, a instancias de la expedición de las norn1as, la formulación de las políticas y el control judicial constitucional; dando cuenta de su inherente vínculo con tensiones del orden social, político, econó1nico, cultural y ambiental.
