Excerpt from Irrigation Districts in California: 1887-1915 The irrigation district is now an established institution in California, First authorized in California on a comprehensive basis in 1887, after an agitation in favor of neighborhood irrigation extending over at least fifteen years, and with extreme bitterness toward riparian proprietors, following the decision in Lux vs. Hoggin, probably furnishing much of the motive force that carried the Wright act of 1887 through the legislature, it has been found to be a workable and desirable plan for community ownership and operation of irrigation works. It is not the form of irrigation organization that is numerically strongest in California, nor is it very likely to attain numerical precedence over the co-operative or mutual irrigation company. Neither is it the form of organization under which the largest acreage is now irrigated in this State. It is, however, the form of organization that is now most generally considered both for new and for the reorganization of old irrigation development in California, as it is the form that has been most largely employed in this State in the more important new irrigation development and reorganization of the present decade. The irrigation district idea did not originate in California. Prior to the passage of the Wright act, Italy, France, and Spain had provided for neighborhood irrigation systems to which the district plan is somewhat similar. Municipal organization had also been employed in drainage. The first irrigation district legislation in the United States was passed by Utah in 1865. That legislation provided that county clerks, on application of a majority of landowners in areas proposed to be organized, should create districts. In those districts landowners were the electors, if land taxes were to be levied, or taxpayers, if general property taxes. A few districts were formed under that act, but nothing important was accomplished. The first California irrigation district act was passed in 1872, "An act to promote irrigation by the formation of irrigation districts." It provided that owners of lands desiring to irrigate or drain them might petition the county supervisors for the formation of irrigation districts. Excerpt from California Irrigation District Laws This bulletin contains in complete form only those laws relating to California irrigation district organizations which come before the state engineer or the state bond certification commission for some part of their procedure. There are other statutes providing for additional forms of organization with which neither the state engineer nor bond certification commission has any official duties. Such statutes are briefly described herein but are not included. The extent to which the different forms of irrigation district laws have been utilized in the irrigation development of the state has made it desirable to assemble such acts together with their amendments in convenient published form. The number and importance of the changes made in these acts at each session of the legislature has made it essential to revise these publications following each session. This has been done, and the bulletins of this department containing these laws for past years are listed together with other bulletins of the department on the inside back cover of this publication. There are other acts relating to the functions of the Division of Water Resources which are not contained in this bulletin. Such acts include the water commission act, and the act relating to the supervision of dams. References to separate publications of these acts, where available, are also given inside the back cover of this bulletin. The wide variation in the conditions in different areas desiring to organize for irrigation development in California has resulted in the enactment of a similarly wide variety of acts for such purposes. Such variations include those of size of the area to be organized, extent and character of the purposes to be accomplished, extent of the cost, nature of land ownership, and type of agricultural practice. For areas requiring extensive financing carefully worked out acts providing for the procedure for such financing are available. For areas of low cost desiring simplicity of operation, less formal types of organization may be used. There follows a brief discussion of the various California conservation acts, the first five of which are published in full in this bulletin. This discussion is a summary of a similar part of Bulletin 21 of the Department of Public Works, Division of Engineering and Irrigation, entitled "Irrigation Districts in California," which contains detail information regarding individual districts organized under the more important acts. California Irrigation District Act. This term is used specifically to describe the act governing organizations formed under the older or Wright irrigation district law with its subsequent amendments. While organizations under all similar laws are in a general sense, irrigation districts, other laws have been given various distinguishing titles in an effort to avoid confusion. This act is also frequently referred to as the California Irrigation District Act. The original or Wright Act, passed in 1887, was largely rewritten by the Bridgeford Act in 1897, and has been extensively amended by nearly every recent legislature. Seventy-two districts are listed with a total bonded indebtedness of This represents a reduction of over 251 in the amount outstanding prior to reorganization. All of the districts that were reorgani zed and placed on a sound financial basis have continued to meet their payments when due and are rapidly reducing the amount of outstanding obligations. Seventy-four of the districts levied a total of in assessments for the year l94l-1942. The average delinquency in payment of assessments on the date of last tax sale was for the group as a whole. Excerpt from California Irrigation District Laws as Amended 1919 The irrigation districts legally in existence December 1, 1919, are listed below. This list does not include several of the original Wright Act districts organized prior to 1895 which for one reason or another have never been formally dissolved, but which have never been active. The list, however, does include six districts approved by the state engineer and organized in 1919 but not yet fully operating; three organized in 1919 but not reported on by the state engineer; and twelve organized after 1913 and prior to 1919 for which no satisfactory plans for construction or operation have yet been made and which have issued no bonds. Of the 52 listed, something over 32 may be properly considered as Operating. Some of the 32 have merely taken over more or less complete water systems built by former mutual or public utility companies and may or may not be in full working order; others have completed most of their construction and, are thoroughly established. Excerpt from Report on Irrigation Districts in California: For the Year 1930 The data contained in this report have been assembled by the office of the State Engineer, Division of Water Resources, Department of Public Works. from information furnished by the irrigation districts of the State. This information has been analyzed and checked, and while it is believed to be substantially correct and reliable, there may be minor inaccuracies in individual cases. Three earlier reports have been published on this subject, giving complete information of irrigation districts and the irrigation district movement in California up to and including 1929. These earlier reports are presented in Bulletin 2 (1916) of the State Department of Engineering, Bulletin 21 (1929) of the Department of Engineering and Irrigation and Bulletin 21-A (1930) of Division of Water Resources. The present report is published for the purpose of continuing this series of bulletins and bringing up to date historical and statistical data on California irrigation districts, and recording such other information as was obtained on irrigation district activities in 1930. It is desired to express the appreciation of this office for the cooperation of district officials. Through their generally prompt response to our requests for information, we have been able to prepare for publication the irrigation district bulletin for 1930 three months earlier in the year than was possible for the 1929 report.
