Excerpt from International Law Topics and Discussions The Navy Department, as has been the practice in recent years, assembled at the Naval War College on June 1, 1905, a conference of officers, a majority of whom were of high rank and long experience, to occupy four months in the discussion of the battle tactics and strategy of the fleet, and of those unsettled questions of international law which at times have seemed to threaten universal war. The topics considered in this volume are of vital interest, and it is desirable to make clear the manner in which the work was performed. They were formulated before the opening of the conference by the lecturer, Mr. George Grafton Wilson, professor in Brown University, in consultation with the president and staff of the War College. The officers were divided into committees when the conference assembled, and at stated intervals the committees submitted reports upon the several topics; the reports were then fully and freely discussed in a general conference participated in by the lecturer, the president and staff of the college, and all the officers in attendance. The conclusions published are those accepted in the general conference and may be fairly held to be without bias, since it is evident that in the future the United States may be affected either as neutral or as belligerent, and since the topics do not relate to questions pending. The field is wide and the time limited, but the work is justified, if besides increasing our knowledge it has contributed in any degree to the formulation of agreements tending to avert or ameliorate war. Excerpt from International Law and International Relations, an Attempt to Ascertain the Best Method of Discussing the Topics of International Law The following essay is a dissertation which I wrote last year as a candidate for a Fellowship at King's College, Cambridge. Except in so far as it deals with the theory of International Law it is necessarily a mere sketch, as my object was only to state a theory and to give an outline of its application. It has interested some of its few readers sufficiently to encourage me to publish it. I have not amplified it at all because I can see no value in any work occupying an intermediate position between an essay intended to excite interest in the subject and to indicate what might be done and an elaborate work on International Law such as I may hope to write some day but for which much time and labour would be required. At the same time I have revised the essay and made some alterations in it. Its nature and purpose are further explained in the introductory letter which was prefixed to it in its earlier form and which I here reprint. I have not relegated important matter to notes, nor printed on my pages long quotations from other authors or excerpts from original authorities. I have preferred the much more labo rions task of extracting their substance and putting it in my own words into the body of the book, which I trust has gained thereby in both the decrease of bulk and increase of readableness. But I have taken care to provide the means of checking my assertions. At the bottom of nearly every page will be found references, by the use of which teachers and students can amplify or correct the statements in the text and men of aflairs obtain the more detailed information they may want for practical purposes. The notes are, I h0pe, sufficient. My object has been to make them adequate without over loading them with matter. Excerpt from Essays on Some Disputed Questions in Modern: International Law Expedition of 1882, refers in eulogistic terms to the ably planned and well executed operations whereby our fleet seized the Suez Canal. He then adds, The inference to Americans is obvious, that the neutrality of any canal joining the waters of the Atlantic and Pacific Oceans will be maintained, if at all, by the nation which can place and keep the strongest Ships at each extremity. No doubt the gallant Commander is right, so far as physical force is concerned; but, with regard to the legal aspect of the case, I have contended that all the states interested in the canal must concur in its neutralization, before the status of neutrality can be conferred upon it. Here again my view receives con firmation from current authority; for I see in the news papers that the International Peace and Arbitration Conference, assembled at Berne early in the present month, resolved that a guarantee of all the maritime powers was necessary in order to effect the neutralization OF interoceanic canals. I have said that the Essays are greatly amplified lectures; and this is true of all except the fifth. When I came to revise it for publication, the subject appeared so great that a treatise would be required to deal with it completely. I have therefore been content to elaborate a little more fully one or two points which were the pivots of my argument, sending the rest of the lecture to press in almost the same form as it was delivered.
