This edition of the Inter-American Yearbook on Human Rights , like the volumes that precede it, includes information concerning the activities of the Organization of American States in the promotion & protection of human rights. It begins with the composition of the Commission & Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions & reports by the Commission & historic correspondences & decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly. The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the Velásquez Rodríguez case (Honduras). This historic decision is reproduced in Part Three of this volume. Another important 1988 development in the Inter-American system was the Protocol of San Salvador, or Additional Protocol to the American Convention on Human Rights for Economic, Social & Cultural Rights, reproduced in Part Four. Also included, in its entirety, is a report on the human rights situation in Haiti, a report requested by the Organization of American States Permanent Council in Resolution 502. This study demonstrates the extensive protection that international law provides to human rights even in the most serious of emergencies when they are particularly vulnerable. Based on a meticulous analysis of preparatory works and practice under the International Covenant on Civil and Political Rights, as well as the American and European Conventions on Human Rights, and with a special chapter on the International Labour Organisation's approach to international labour standards and emergencies, this book shows that respect for the rule of law and the concept of a democratic society are controlling parameters in any valid limitation on the enjoyment of human rights. It further shows that respect for human rights and the operation of institutions such as the Legislature and Judiciary are crucial to enabling societies to address and eventually remedy the root causes of emergency situations. The study recommends possible directions for the development of case law and suggests some practical means to help ensure that international legal requirements are in fact respected in emergencies.

In the early years of the recent Central American crisis, analysts often predicted a rapid, dramatic resolution—whether by revolutionary victory or through military intervention by the United States. The 1980s, however, have witnessed an intensification of conflicts with increasing U.S. involvement. Rather than standing at the brink of a sharp turning point, Central America is at an interim point in an evolving historical process. This text provides an assessment of this process and of its immediate and long-term implications for the region and for U.S.-Latin American relations. It focuses on the complex and contradictory effects of the Reagan administration's efforts to influence the Central American debate within the United States and to reestablish U.S. hegemony in the region itself. The first part of the book examines the development of various aspects of U.S. policy toward Central America. In particular, contributors discuss the interaction between the executive and legislative branches in shaping U.S. strategy, the implications for constitutional democracy of presidential control over foreign policymaking, the treatment of Central American refugees, the counterinsurgency strategy of "low intensity warfare," and the effects of U.S. policy on regional peace initiatives put forward by Mexico and other Latin American countries.
