This book is a legal and political intervention into a contemporary debate concerning the appropriateness of sexual offence prosecutions brought against young gender non-conforming people for so-called ‘gender identity fraud'. It comes down squarely against prosecution. To that end, it offers a series of principled objections based both on liberal principles, and arguments derived from queer and feminist theories. Thus prosecution will be challenged as criminal law overreach and as a spectacular example of legal inconsistency, but also as indicative of a failure to grasp the complexity of sexual desire and its disavowal. In particular, the book will think through the concepts of consent, harm and deception and their legal application to these specific forms of intimacy. In doing so, it will reveal how cisnormativity frames the legal interpretation of each and how this serves to preclude more marginal perspectives. Beyond law, the book takes up the ethical challenge of the non-disclosure of gender history. Rather than dwelling on this omission, it argues that we ought to focus on a cisgender demand to know as the proper object of ethical inquiry. Finally, and as an act of legal and ethical re-imagination, the book offers a queer counter-judgment to R v McNally, the only case involving a gender non-conforming defendant, so far, to have come before the Court of Appeal.

It is with deep gratitude that we give credit to the 80 individuals in our sample who allowed us to explore these processes in their lives. Both of us believed that research on the Eriksonian concept of intimacy was deficient in that it was limited to the reports of individuals about them selves. A photograph of two men, cowboy-hatted and -booted and discreetly holding hands, is the departure point in a groundbreaking study on masculinity and homosexuality in Mexico. Just Between Us, an ethnography of intimacy and affection between men, explores the concept of masculine identity and homoeroticism, expressing the difficulties men face in maintaining their masculinity while expressing intimacy and affection. Using fieldwork from rural Sonora, Mexico, Guillermo Núñez Noriega posits that men accept this intimacy outside gender categories and stereotypes, despite the traditional patriarchal society. This work contests homophobia and the heterosexual ideal of men and attempts to break down the barriers between genders. The photograph Núñez Noriega uses to explore the shifting attitudes and perceptions of sexuality and gender provokes more questions than answers. Recognizing the societal regulations at play, the author demonstrates the existence in contemporary Mexico of an invisible regime of power that constructs and regulates the field of possibilities for men’s social actions, especially acts of friendship, affection, and eroticism with other men. The work investigates “modes of speaking” about being a man, on being gay, on the implicit meanings of the words homosexual, masculine, trade, fairy, and others—words that construct possibilities for intimacy, particularly affective and erotic intimacy among men. Multiple variants of homoeroticism fall outside the dominant model, Núñez Noriega argues, a finding that offers many lessons on men and masculine identities. This book challenges patriarchal definitions of sex, gender, and identity; it promotes the unlearning of dominant conventions of masculinity to allow new ways of being.

Recent Western thought has consistently emphasized the individualistic strand in our understanding of persons at the expense of the social strand. Thus, it is generally thought that persons are self-determining and autonomous, where these are understood to be capacities we exercise most fully on our own, apart from others, whose influence on us tends to undermine that autonomy. Love, Friendship, and the Self argues that we must reject a strongly individualistic conception of persons if we are to make sense of significant interpersonal relationships and the importance they can have in our lives. It presents a new account of love as intimate identification and of friendship as a kind of plural agency, in each case grounding and analyzing these notions in terms of interpersonal emotions. At the center of this account is an analysis of how our emotional connectedness with others is essential to our very capacities for autonomy and self-determination: we are rational and autonomous only because of and through our inherently social nature. By focusing on the role that relationships of love and friendship have both in the initial formation of our selves and in the on-going development and maturation of adult persons, Helm significantly alters our understanding of persons and the kind of psychology we persons have as moral and social beings.
