This report with evidence examines the constitutional aspects that stem from the challenges to the Hunting Act 2004. The Hunting Act, received Royal Assent on 18 November 2004, but was accompanied by controversy due the passage of the legislation through Parliament. The Bill was originally introduced on 3 December 2002, but did not complete all its stages in the House of Lords. Reintroduced on 9 September 2004, the House of Commons invoked the Parliament Acts to force through the Bill, ignoring amendments made in the House of Lords. The Select Committee on the Constitution invited Professor Rodney Brazier to provide an authoritative account of the genesis, main provisions and use of the Parliament Acts. This work is contained in Appendix 1. The hunting ban came into effect on 18 February 2005, with challenges to the legality of the Parliament Acts by pro-hunting groups failing in the Administrative Court and Court of Appeal. An analysis of the decisions against the appeals taken in particular by the Court of Appeal in regard of the Parliament Acts 1911-1949 has raised difficult questions about the use of these acts in making future constitutional changes. Appendix 2 contains decisions of the Administrative Court and Court of Appeal.

Children are taken on rite-of-passage hunting trips, where relationships are cemented and legacies are passed on from one generation to another. Meals are prepared from hunted game, often consisting of regionally specific dishes that reflect a community’s heritage and character. Deer antlers and bear skins are hung on living room walls, decorations and relics of a hunter’s most impressive kills. Only 5 percent of Americans are hunters, but that group has a substantial presence in the cultural consciousness. Hunting has spurred controversy in recent years, inciting protest from animal rights activists and lobbying from anti-cruelty demonstrators who denounce the custom. But hunters have responded to such criticisms and the resulting legislative censures with a significant argument in their defense—the claim that their practices are inextricably connected to a cultural tradition.
