Book Description
Hazardous Materials Regulations - Combustible Liquids (US Pipeline and Hazardous Materials Safety Administration Regulation) (PHMSA) (2018 Edition) The Law Library presents the complete text of the Hazardous Materials Regulations - Combustible Liquids (US Pipeline and Hazardous Materials Safety Administration Regulation) (PHMSA) (2018 Edition). Updated as of May 29, 2018 PHMSA is considering amendments to the Hazardous Materials Regulations (HMR) as they apply to the transportation of combustible liquids. Specifically, we are considering whether to harmonize the domestic regulations applicable to the transportation of combustible liquids with international transportation standards. In addition, we are examining ways to revise, clarify, or relax certain regulatory requirements to facilitate the transportation of these materials while maintaining an adequate level of safety. The intent of this ANPRM is to invite public comments on how to accomplish these goals, provide an opportunity for comment on amendments PHMSA is considering, and present a forum for the public to offer additional recommendations for the safe transportation of combustible liquids. Updated as of May 29, 2018 The Pipeline and Hazardous Materials Safety Administration is issuing this final rule to codify in the Hazardous Materials Regulations certain mandates and minimum requirements of the FAST Act. Specifically, the FAST Act mandates a revised phase-out schedule for all DOT Specification 111 tank cars used to transport unrefined petroleum products (e.g., petroleum crude oil), ethanol, and other Class 3 flammable liquids. The FAST Act also requires that each tank car built to meet the DOT Specification 117 and each non-jacketed tank car retrofitted to meet the DOT Specification 117R be equipped with a thermal protection blanket that is at least 1/2-inch thick and meets existing thermal protection standards. Further, the FAST Act mandates minimum top fittings protection requirements for tank cars retrofitted to meet the DOT Specification 117R. Book Description
Hazardous Materials - Enhanced Tank Car Standards and Operational Controls for High-Hazard Flammable Trains (US Pipeline and Hazardous Materials Safety Administration Regulation) (PHMSA) (2018 Edition) The Law Library presents the complete text of the Hazardous Materials - Enhanced Tank Car Standards and Operational Controls for High-Hazard Flammable Trains (US Pipeline and Hazardous Materials Safety Administration Regulation) (PHMSA) (2018 Edition). Updated as of May 29, 2018 In this final rule, the Pipeline and Hazardous Materials Safety Administration (PHMSA), in coordination with the Federal Railroad Administration (FRA), is adopting requirements designed to reduce the consequences and, in some instances, reduce the probability of accidents involving trains transporting large quantities of flammable liquids. The final rule defines certain trains transporting large volumes of flammable liquids as "high-hazard flammable trains" (HHFT) and regulates their operation in terms of speed restrictions, braking systems, and routing. The final rule also adopts safety improvements in tank car design standards, a sampling and classification program for unrefined petroleum-based products, and notification requirements. These operational and safety improvements are necessary to address the unique risks associated with the growing reliance on trains to transport large quantities of flammable liquids. They incorporate recommendations from the National Transportation Safety Board (NTSB) and from the public comments, and are supported by a robust economic impact analysis. Hazardous Materials - Combination Packages Containing Liquids Intended for Transport by Aircraft (US Pipeline and Hazardous Materials Safety Administration Regulation) (PHMSA) (2018 Edition) The Law Library presents the complete text of the Hazardous Materials - Combination Packages Containing Liquids Intended for Transport by Aircraft (US Pipeline and Hazardous Materials Safety Administration Regulation) (PHMSA) (2018 Edition). Updated as of May 29, 2018 PHMSA and the Federal Aviation Administration (FAA) are considering changes to requirements in the Hazardous Materials Regulations applicable to non-bulk packagings used to transport hazardous materials in air transportation. To enhance aviation safety, the two agencies are seeking to identify cost-effective solutions that can be implemented to reduce incident rates and potentially detrimental consequences without placing unnecessary burdens on the regulated community. We are soliciting comments on how to accomplish these goals, including measures to: (1) Enhance the effectiveness of performance testing for packagings used to transport hazardous materials on aircraft; (2) more clearly indicate the responsibilities of shippers that offer packages for air transport in the Hazardous Materials Regulations (HMR); and (3) authorize alternatives for enhancing package integrity. We are also considering ways to simplify current requirements. Commenters are also invited to present additional ideas for improving the safe transportation of hazardous materials by aircraft. Book Description
Hazardous Materials - Incorporation of Special Permits into Regulations (US Pipeline and Hazardous Materials Safety Administration Regulation) (PHMSA) (2018 Edition) The Law Library presents the complete text of the Hazardous Materials - Incorporation of Special Permits into Regulations (US Pipeline and Hazardous Materials Safety Administration Regulation) (PHMSA) (2018 Edition). Updated as of May 29, 2018 The Pipeline and Hazardous Materials Safety Administration is proposing to amend the Hazardous Materials Regulations to incorporate provisions contained in certain widely used or longstanding special permits that have an established safety record. Special permits allow a company or individual to package or ship a hazardous material in a manner that varies from the regulations so long as an equivalent level of safety is maintained. The proposed revisions are intended to provide wider access to the regulatory flexibility offered in special permits and eliminate the need for numerous renewal requests, thus reducing paperwork burdens and facilitating commerce while maintaining an appropriate level of safety.
