Intellectual Property Rights in a Fair World Trade System

Intellectual Property Rights in a Fair World Trade System PDF Author: Annette Kur
Publisher: Edward Elgar Publishing
ISBN: 1849809585
Category : Law
Languages : en
Pages : 637

Book Description
Intellectual Property law (IP) - particularly in relation to international trade regimes - is increasingly finding itself challenged by rapid developments in the technological and global economic landscapes. In its attempt to maintain a responsive legislative system that is interacting successfully with global trade rules, IP is having to respond to an increasing number of actors on an international level. This book examines the problems associated with this undertaking as well as suggesting possible revisions to the TRIPS agreement that would make it more relevant to the environment in which today's IP mechanisms are operating. The overall aim is to find an adequate response to the 'IP balance dilemma'. The theme is pursued throughout various topics, including a look at what this means in relation to economy in a country like China, and also considering how IP is increasingly having to reconcile itself with human rights issues.

Children and Television

Children and Television PDF Author: Norma Pecora
Publisher: Routledge
ISBN: 113525138X
Category : Language Arts & Disciplines
Languages : en
Pages : 700

Book Description
This seminal volume is a comprehensive review of the literature on children's television, covering fifty years of academic research on children and television. The work includes studies of content, effects, and policy, and offers research conducted by social scientists and cultural studies scholars. The research questions represented here consider the content of programming, children's responses to television, regulation concerning children's television policies, issues of advertising, and concerns about sex and race stereotyping, often voicing concerns that children's entertainment be held to a higher standard. The volume also offers essays by scholars who have been seeking answers to some of the most critical questions addressed by this research. It represents the interdisciplinary nature of research on children and television, and draws on many academic traditions, including communication studies, psychology, sociology, education, economics, and medicine. The full bibliography is included on CD. Arguably the most comprehensive bibliography of research on children and television, this work illustrates the ongoing evolution of scholarship in this area, and establishes how it informs or changes public policy, as well as defining its role in shaping a future agenda. The volume will be a required resource for scholars, researchers, and policy makers concerned with issues of children and television, media policy, media literacy and education, and family studies.

Formalities in Copyright Law

Formalities in Copyright Law PDF Author: Stef van Gompel
Publisher: Kluwer Law International B.V.
ISBN: 9041134182
Category : Law
Languages : en
Pages : 370

Book Description
This book examines whether reintroducing copyright formalities is legally feasible. Based on a comprehensive and thorough analysis of copyright formalities, it sets out to establish the extent to which the current copyright system allows for their reintroduction. To this end, the author describes the role and functions of formalities, revisits the history of formalities at the national and international levels, examines the scope of the international prohibition on formalities, and scrutinizes the rationales behind this prohibition, including an in-depth examination of the validity of the argument that copyright is a 'natural right' and therefore should be protected independently of formalities. The author skilfully evaluates and contrasts the conflicting theories according to which formalities, on the one hand, add legal certainty to claims on the ownership of property, and, on the other, hamper individual authors from seeking adequate protection for their works. This book makes an important contribution to legal science by answering questions that so far have been neglected or only marginally addressed. To the degree that current copyright law permits reintroducing formalities, the author posits the specifications that will determine to a great extent what role and functions they may eventually fulfil: depending on the aims to be achieved, lawmakers must choose which types of formalities shall be imposed, and what their legal consequences shall be. This book goes a long way towards reinforcing the foundation for those decisions.
