Jenny was recovered by the testator in a previous suit and Rebecca was born to the slave Jenny while she was still in the defendant's possession, before the recovery had been obtained. Defendant took the slave Jenny from Wayne county to Warren county as agreed when hired and gave his brother-in-law Lane, her child Rebecca, in return. Lane agreed to this. There was no evidence on how Jenny had been taken into the possession of the defendant in the first place. The plaintiff sent an agent to get Rebecca back from the defendant, but he said she was with Lane. The lower court dismissed the action because there was no proof either of a demand before the suit was brought, or of possession in the defendant when the writ was sued out. The plaintiff appealed and succeeded in getting the judgment reversed and a new trial was called.
