Do human rights offer real protection when disadvantaged groups invoke them at the local level in an attempt to improve their living conditions? If so, how can we make sure that the experiences of those invoking human rights at the local level have an impact on the further development of human rights (at national and other levels) so that the local relevance of human rights increases? Since the adoption of the Universal Declaration of Human Rights (UDHR) on 10 December 1948, numerous international documents have reaffirmed human rights as global norms. This book examines what factors determine whether appeals to human rights that emanate from the local level are successful, and whether the UDHR adequately responds to threats as currently defined by relevant groups or whether a revision of some of the ideas included in the UDHR is needed in order to increase its contemporary relevance.

This book examines human rights as political battlefields, spaces that are undergoing constant changes in which political conflicts are expressed by a translation process within networks of interactions. This translation, in turn, contributes to modifying the scope and understanding of human rights. Ultimately, these battlefields express the legitimacy encounter of different versions of human rights in contemporary political practices. The volume thus challenges both the tendency to minimize the changing nature of human rights as well as the struggles emerging from the use of human rights discourses as a legitimization tool. "For decades, studies of oil-related conflicts focused on the causes and effects of natural resources mismanagement, commonly known as the "resource curse"-the paradoxical connection between oil wealth and economic busts (as in Venezuela) or, in a later twist, the link between the predatory behavior of armed rebel organizations and the abundant natural resources that funded their existence. Patricia Vasquez notes that oil busts and civil wars associated with the resource curse were quite different from the now-predominant local hydrocarbons disputes that are multiplying rapidly in Latin America. These more recent, localized disputes-over land, population displacement, water contamination, oil jobs that are promised but never materialize, etc.-primarily involve Indigenous groups with a different social and cultural identity from the rest of the population. Vasquez spent fifteen years making regular field visits to the oil-producing regions of Latin America and conducting hundreds of interviews with the various stakeholders in these local conflicts. This book explores the comparative historical evolution of the European, Inter-American and African regional human rights systems. The book devotes attention to various factors that have shaped the systems: the different circumstances in which they were founded; the influence of major states and inter-state politics within their respective regions; gradual processes of institutional evolution; and the impact of human rights advocates and claimants. Throughout, the book devotes careful attention to the impact of institutional and procedural choices on the functioning of human rights systems. Overarchingly, the book explores the contextually-generated differences between the three systems, suggesting that human rights practice is less unitary than it might at times appear. Prescriptively, the book proposes that, contrary to the received wisdom in some quarters, the Inter-American system's dual-track approach may provide the most promising model in regards to future human rights system design.
