Borderscapes

Borderscapes PDF Author: Prem Kumar Rajaram
Publisher: U of Minnesota Press
ISBN: 1452913234
Category :
Languages : en
Pages : 372

Book Description
Connecting critical issues of state sovereignty with empirical concerns, Borderscapes interrogates the limits of political space. The essays in this volume analyze everyday procedures, such as the classifying of migrants and refugees, security in European and American detention centers, and the DNA sampling of migrants in Thailand, showing the border as a moral construct rich with panic, danger, and patriotism. Conceptualizing such places as immigration detention camps and refugee camps as areas of political contestation, this work forcefully argues that borders and migration are, ultimately, inextricable from questions of justice and its limits. Maritime Delimitation

Maritime Delimitation PDF Author: Rainer Lagoni
Publisher: BRILL
ISBN: 9004150331
Category : Law
Languages : en
Pages : 255

Book Description
The delimitation of maritime zones is an important requirement for peaceful relations between neighbouring States. There are numerous examples of areas between States with opposite or adjacent coasts where sovereignty over an island or territory may not be contested but the delimitation of the continental shelf and exclusive economic zone is still pending. Under the Law of the Sea Convention, the delimitation of these zones shall be effected by agreement on the basis of international law. However, the Convention does not offer a definitive answer as to the methods that should be applied. This publication includes contributions by Judges of the International Tribunal for the Law of the Sea, eminent scholars and experienced practitioners. The papers deal with various aspects of maritime delimitation: the jurisprudence of international courts and tribunals and their relevance for delimitation, the impact of the Law of the Sea Convention, the role of legal practitioners and diplomatic negotiators, and delimitation under particular geological circumstances and in geographically complex regional situations. It is designed to provide insight and guidance to the complicated process of maritime delimitation.

The Challenge of the Threshold

The Challenge of the Threshold PDF Author: Jocelyne Streiff-Fenart
Publisher:
ISBN: 9780739165119
Category : Africa
Languages : en
Pages : 0

Book Description
The containment policies aimed at regulating immigration flows towards Europe and emerging economies like South Africa have profoundly altered the dynamics of migration in Africa. Drawing on original empirical research, this volume explores the notion of threshold as an operative concept to envisage in turn: the discursive frameworks of containment policies, the challenges to local spaces and their equilibrium, and finally, the sense of liminality experienced by migrants caught in those situations.

Sovereign Bodies

Sovereign Bodies PDF Author: Thomas Blom Hansen
Publisher: Princeton University Press
ISBN: 1400826691
Category : Social Science
Languages : en
Pages : 379

Book Description
9/11 and its aftermath have shown that our ideas about what constitutes sovereign power lag dangerously behind the burgeoning claims to rights and recognition within and across national boundaries. New configurations of sovereignty are at the heart of political and cultural transformations globally. Sovereign Bodies shifts the debate on sovereign power away from territoriality and external recognition of state power, toward the shaping of sovereign power through the exercise of violence over human bodies and populations. In this volume, sovereign power, whether exercised by a nation-state or by a local despotic power or community, is understood and scrutinized as something tentative and unstable whose efficacy depends less on formal rules than on repeated acts of violence. Following the editors' introduction are fourteen essays by leading scholars from around the globe that analyze cultural meanings of sovereign power and violence, as well as practices of citizenship and belonging--in South Africa, Peru, India, Mexico, Cyprus, Norway, and also among transnational Chinese and Indian populations. Sovereign Bodies enriches our understanding of power and sovereignty in the postcolonial world and in "the West" while opening new conceptual fields in the anthropology of politics. The contributors are Ana María Alonso, Lars Buur, Partha Chatterjee, Jean Comaroff and John L. Comaroff, Oivind Fuglerud, Thomas Blom Hansen, Barry Hindess, Steffen Jensen, Achille Mbembe, Aihwa Ong, Finn Stepputat, Simon Turner, Peter van der Veer, and Yael Navaro-Yashin.

Predictability and Flexibility in the Law of Maritime Delimitation

Predictability and Flexibility in the Law of Maritime Delimitation PDF Author: Yoshifumi Tanaka
Publisher: Bloomsbury Publishing
ISBN: 150991210X
Category : Law
Languages : en
Pages : 606

Book Description
This fully revised new edition offers a comprehensive picture of the law of maritime delimitation, incorporating all new cases and State practice in this field. As with all types of law, the law of maritime delimitation should possess a degree of predictability. On the other hand, as maritime delimitation cases differ, flexible considerations of geographical and non-geographical factors are also required in order to achieve equitable results. How, then, is it possible to ensure predictability while taking into account a number of diverse factors in order to achieve an equitable result? This is the question at the heart of the law of maritime delimitation. This book explores a well-balanced legal framework that reconciles predictability and flexibility in the law of maritime delimitation by looking at three aspects of the question: first it reviews the evolution of the law of maritime delimitation; second, it undertakes a comparative study of the case law and State practice; and third, it critically assesses the law of maritime delimitation in its current form.
