Esta tesis está dedicada a la reparación de daños al medio ambiente. En ella se presentan fundamentos de orden ética y jurídica para justificar la presunción de daños ambientales como medio de propiciar su reparación en situaciones en las cuales la comprobación de ocurrencia es especialmente compleja o difícil. Se estudia también la evolución de la responsabilidad civil para demostrar que a lo largo del proceso de emigración de la culpa al riesgo, todavía en curso, también hubo adopción de presunciones como alternativa para posibilitar la solución de casos sometidos a los tribunales que no podrían ser resueltos si fuese indispensable producir prueba cabal de la culpa del agente. Con este estudio se quiso demostrar que el deseo de promover la reparación de daños, en el pasado, hizo que la jurisprudencia, la doctrina y el legislador procediesen a realizar sucesivos perfeccionamientos en los procedimientos de responsabilidad civil, tal como se propone ahora, en relación con los daños ambientales, en los Capítulos 4 y 5.
