De son appropriation par les aliénistes au XIXe siècle à la confusion de la punition et du soin promue par la nouvelle pénologie, la transgression violente a toujours concerne le psychiatre.Alors que les recherches en criminologie de ces trente dernières années tendent à disculper les pathologies mentales dans la genèse de la grande majorité des actes violents, et qu’en parallèle la capacité du clinicien à les prévoir est sérieusement contestée, l’expert psychiatre est sollicité de façon croissante en ce sens par le législateur. Des instruments d’évaluation standardisée de la dangerosité ont été élaborés visant à une meilleure prédiction du risque de récidive basée sur des variables statistiquement corrélées à celle-ci. Nous examinons les instruments d’usage courant en pratique expertale, qui se partagent entre une approche actuarielle pure s’appuyant sur des facteurs statiques, et une approche y associant des facteurs dynamiques permettant un jugement clinique structuré. Leur valeur prédictive ainsi que leurs limites sont discutées et nous tentons de comprendre la méfiance des praticiens français à leur égard. Enfin nous illustrons par un cas clinique l’apport de ces outils standardisés et les questions que soulève leur mise en œuvre pratique.

L'évaluation du risque de récidive chez les auteurs de violence, à travers l'expertise psychiatrique pénale connaît un intérêt grandissant en psychiatrie légale. Si la mission expertale a évolué pour répondre aux attentes d'une politique sécuritaire et de gestion des risques, les pratiques de l’expertise semblent avoir peu évoluées en France, comme en témoigne la faible utilisation d'outils pour aider l'expert dans la détermination d’un pronostic. Pour évaluer ce risque, la détermination du profil psychopathique chez les auteurs de violence semble essentielle, des liens entre psychopathie et violence étant établis.
