Publisher: Springer
ISBN: 9401511950
Category : Law
Languages : en
Pages : 204

Book Description
This is the first volume in a new series of European Yearbooks in Law and Sociology. As the Editorial Board we have considerable pleasure in being able to inaugurate this series, and to do so with a collection of articles from such distinguished contributors. For a number of years the need for a regular outlet for European work in law and sociology has been appreciated, and many individuals have co-operated in laying the foundations for this series. The we are preparatory work that was done has been most valuable. Equally delighted that the series is launched with the encouragement and backing of both the Research Committee on Sociology of Law of the International Sociological Association and the Institute of Sociology of Law for Europe. Indeed the current activities of the Research Committee and the recent establishment of the Institute, together with this series of Yearbooks, permit optimism that work in this field in Europe will progress and develop as never before. Whether this will happen does depend however, quite simply, on the nature of the research and writing that follows and the quality of work accomplished.

The Anxiety of the Jurist

The Anxiety of the Jurist PDF Author: Claudio Michelon
Publisher: Routledge
ISBN: 1317044916
Category : Law
Languages : en
Pages : 374

Book Description
The contributions in this volume pay homage to Zenon Bańkowski, with a focus on problems concerning law’s normalization and the revitalizing force of anxiety. Ranging from political critique to methodological issues and from the role of human rights in development to the role of parables and analogy in legal reasoning, the contributions themselves are testament to the richness of Bańkowski’s scholarship, as well as to the applicability of his core ideas to a wide range of issues. Divided into five parts, the book focuses on the role and methods of the jurist; conceptions of legality and the experience of living under rules; jurisprudential issues affecting exchange and the market; and the burden and methods of legal judgement. It also includes Bańkowski’s 2011 valedictory lecture and a bibliography of his work. Comprising all original contributions, the contributors represent a balance of established, leading figures and younger, emerging scholars in the field of legal and social theory.

Women, Their Lives, and the Law

Women, Their Lives, and the Law PDF Author: Victoria Barnes
Publisher: Bloomsbury Publishing
ISBN: 1509962107
Category : Law
Languages : en
Pages : 315

Book Description
This collection of essays honours Rosemary Auchmuty, Professor of Law at the University of Reading, UK. She has fostered the study of women's academic careers and, more politically, advanced progress on gender and equality issues including same-sex marriage and property law. Her research promotes the case of feminist legal history as a way of revealing the place of women and challenging dominant historical narratives that cast them aside. Just as Rosemary's work does, the book seeks to end the marginalisation and exclusion of women in the legal world, by including them. The book begins fittingly with a discussion of Miss Bebb, the woman whose biography Auchmuty deployed to push feminist legal history into the mainstream. It turns then to a discussion of women known and unknown and their struggles within the legal profession offering within those chapters a critical appraisal of the role of history and biography as a methodology. From there it moves to consider feminist perspectives and critiques of the dominant structures of private law. This is followed by chapters that explore those who educate the legal profession within the academy. The chapters, and the collection as a whole, examine areas of law that have a deep significance for women's lives.

Social and Legal Norms

Social and Legal Norms PDF Author: Matthias Baier
Publisher: Routledge
ISBN: 1317054105
Category : Law
Languages : en
Pages : 364

Book Description
In an era where new areas of life and new problems call for normative solutions while the plurality of values in society challenge the very basis for normative solutions, this book looks at a growing field of research on the relations between social and legal norms. New technologies and social media offer new ways to communicate about normative issues and the centrality of formal law and how normativity comes about is a question for debate. This book offers empirical and theoretical research in the field of social and legal norms and will inspire future debate and research in terms of internationalization and cross-national comparative studies. It presents a consistent picture of empirical research in different social and organizational areas and will deepen the theoretical understanding regarding the interplay between social and legal norms. Including chapters written from four different aspects of normativity, the contributors argue that normativity is a result of combinations between law in books, law in action, social norms and social practice. The book uses a variety of different international examples, ranging from Sweden, Uzbekistan, Colombia and Mexico. Primarily aimed at scholars in sociology of law, socio-legal studies, law and legal theory, the book will also interest those in sociology, political science and psychology.
