A divisão do poder político: do Estado liberal ao Estado social lança um novo olhar sobre as funções do Estado e dos diferentes órgãos encarregados do seu exercício. A obra propõe-se a demonstrar a evolução do processo de divisão do poder político e as transformações dos órgãos encarregados do seu exercício no curso da história. O autor examina como a transformação do Estado foi exigindo a instituição de novos órgãos para o exercício do poder político, abordando a dinâmica da separação dos Poderes e as mudanças percebidas nas feições dos poderes políticos instituídos, especialmente na passagem do Estado liberal ao Estado social. O texto aborda o modo como foi exercido o poder político na Antiguidade – simples divisão funcional do trabalho –, a situação político-social do medievo – período marcado pela fragmentação da sociedade política –, até chegar ao Estado moderno, com o fenômeno da concentração do poder político no Estado e a sua posterior divisão como mecanismo de controle. De um modelo bipartido, com a separação do Parlamento, a divisão avança para uma tripartição, com a independência do Poder Judiciário, e vai em busca do equilíbrio entre Executivo, Legislativo e Judiciário, consagrando-se o modelo liberal de divisão do poder. O estudo revela como a ampliação do campo de atuação do Estado, ao longo dos séculos XVIII e XIX, inviabilizou que se mantivesse a concentração de funções diversas em um único órgão, aprofundando a divisão dos Poderes. O livro delineia, ainda, uma divisão dos Poderes tipo para o Estado social, buscando demonstrar o papel de cada Poder nessa nova conformação, a partir das ideias de decisão, execução e controle político. Partindo dessas ideias, a obra traça linhas verticais e horizontais para distinguir seis Poderes políticos – Chefia de Estado, Governo, Parlamento, Administração Pública, Poder Judiciário e Tribunal Constitucional – e associar cada poder a uma ou mais funções. This book is the edition of the Proceedings of the International Colloquium “Rhetoric and Argumentation in the Beginning of the XXIst Century” which was held at the Faculty of Letters of the University of Coimbra, in October 2-4, 2008, and was organized by Henrique Jales Ribeiro, Joaquim Neves Vicente and Rui Alexandre Grácio. The main purpose of the Colloquium was to commemorate the publication in 1958 of the books La nouvelle rhétorique: Traité de l’argumentation, and The Uses of Arguments, by, respectively, C. Perelman/L. Olbrechts-Tyteca, and S. Toulmin. But another important goal was to take stock of the state of rhetoric and argumentation theory at the beginning of a new century. It was a unique event, without parallel in Portugal and worldwide - considering its theme and its aims -, which gathered some of the World’s most renowned rhetoric and argumentation theorists: Alan Gross, Douglas Walton, Erik Krabbe, Frans V. Eemeren, F. Snoeck Henkemans, Guy Haarscher, John Anthony Blair, Marianne Doury, Oswald Ducrot, Ruth Amossy. The book includes a variety of very important contributions to rhetoric and argumentation theory, ranging from those that naturally fall within the subject matter, to the areas of philosophy, linguistics, communication theory, education theory and law theory. The book analyzes the elite-led efforts to transform the Brazilian legal order in the period between 1930–1975 and how U.S. Power played a major role in such a process. Besides the global circulation of ideas, the book discusses the Brazilian institutional development in the period. A profound "Crisis of Civilization" marked the first decades of the century: the references of space and time vanished with the vertiginous expansion of cities and industries, while a myriad of immigrants and former slaves were alleged to be threatening the country’s traditions. Brazilian elites blamed liberalism for such a "Crisis". Based on a decade of research, this book centralizes Brazilian history in liberalism and offers a genealogy of the jurisprudential and institutional struggles to correct the culture of laissez-faire. This book is devoted to the study of the interplay between religious rules and State law. It explores how State recognition of religious rules can affect the degree of legal diversity that is available to citizens and why such recognition sometime results in more individual and collective freedom and sometime in a threat to equality of citizens before the law.
