Some 2.5 billion human beings live in severe poverty, deprived of such essentials as adequate nutrition, safe drinking water, basic sanitation, adequate shelter, literacy, and basic health care. One third of all human deaths are from poverty-related causes: 18 million annually, including over 10 million children under five. However huge in human terms, the world poverty problem is tiny economically. Just 1 percent of the national incomes of the high-income countries would suffice to end severe poverty worldwide. Yet, these countries, unwilling to bear an opportunity cost of this magnitude, continue to impose a grievously unjust global institutional order that foreseeably and avoidably perpetuates the catastrophe. Most citizens of affluent countries believe that we are doing nothing wrong. Thomas Pogge seeks to explain how this belief is sustained. Operadores do Direito, em geral, e principalmente os processualistas, de modo particular, admitem que o acesso à Justiça deva ser visto como requisito primordial – o mais básico dos direitos fundamentais – no mundo jurídico contemporâneo e isonômico que deve garantir, e não somente proclamar, os direitos de todos. Verifica-se que o acesso à Justiça, na órbita interna, passa a materializar direito fundamental do cidadão, por meio do qual exerce sua cidadania. E antagonicamente, toda a estrutura de ensino jurídico, bem como as suas práticas, não tem dado o devido valor ao tema acesso à Justiça. O Texto Constitucional de 1988 assegurou o acesso à Justiça por um dos instrumentos mais importantes, a saber: o direito de ação, que materializa a porta de entrada para a instauração do devido processo legal, abarcando não apenas a violação propriamente do direito, como também se objetivou amparar a prevenção à ameaça de violação de direito, refletindo, via de consequência, o cenário de um passado recente. A Constituição Federal de 1988 norteou consideravelmente o tema acesso democrático à Justiça, estabelecendo direitos e criando mecanismos para sua defesa. A Constituição brasileira é rica em dispositivos que fundamentam o direito de acesso à prestação jurisdicional. O nível ideal de acesso à Justiça, no ordenamento jurídico, ainda está longe de ser alcançado, e os operadores do direito, em todas as esferas, enfrentam grandes dificuldades materiais e estruturais para por em prática todo potencial de suas aptidões. Em que pese o louvável conteúdo axiológico que emoldura o direito fundamental ao acesso à Justiça, há que se reconhecer que o sistema estabelecido, corriqueiramente, obsta o real alcance de tal direito, abreviando-o, de maneira indevida, o que, por si só, coloca em xeque à própria realização do indivíduo. Além dessas barreiras, existem, ainda, barreiras sociais e econômicas a serem enfrentadas, para que o cidadão possa ver, efetivamente, esse direito constitucional garantido e a sensação de justiça satisfeita. Ora, a partir deste debate, algumas reflexões são colhidas, sob a forma dos capítulos que constituem esta proposta, decorrentes do projeto de iniciação científica intitulado “Pelas Mãos de Alice”, de Boaventura de Souza Santos, em um viés regional: entraves e obstáculos ao acesso ao Poder Judiciário no município de Bom Jesus do Itabapoana-RJ”, e que permite ao leitor pensar a temática. Sendo assim, convidamos a todos a uma leitura prazerosa acerca do material selecionado.
