The Enemy Combatant Papers

The Enemy Combatant Papers PDF Author: Karen J. Greenberg
Publisher: Cambridge University Press
ISBN: 9781107686632
Category : Law
Languages : en
Pages : 1054

Book Description
The Enemy Combatants Papers presents the five major enemy combatant cases of the post-9/11 era. Presented in narrative form, these original documents tell the story that clarifies the questions at the heart of the American detention of alleged combatants in the war on terror. These documents discuss the right to counsel, the right to a trial, the right for the accused to see the evidence against him, and the intersection between domestic and international law. The book highlights the tension between the needs of national security and the liberties allotted to alleged enemies of the state by highlighting the basic question of what the U.S. Constitution guarantees and to whom. In these documents, the reader can follow the evolving arguments about presidential powers in time of war, habeas corpus, the Geneva Conventions, balance of powers, and matters of detention and prisoner treatment. Complemented with a comprehensive timeline and appendices that include the relevant cases from the Civil War, World War II, and the Korean War and the premises for setting up military commissions and Combatant Status Review Tribunals, this book is meant for those who seek to understand the issues - legal, political, and military - that have dominated the search for balance between justice and security in the war on terror.

Enemy Combatant

Enemy Combatant PDF Author: David Winner
Publisher: Tablo Pty Limited
ISBN: 9781944853754
Category : Fiction
Languages : en
Pages : 240

Book Description
ENEMY COMBATANT is a hyper-charged misadventure driven by a young American's rage against his government. After stumbling on evidence of CIA secret prisons in Armenia and Georgia, Peter recruits an old friend to help free a dark-ops detainee -- an impossibly reckless prison-break mission, with no skills and no resources, no connection to the captured soldiers and no solid plan for getting home -- fueled by too much alcohol, a pressure-cooker marriage and the recent death of a parent. Set during the second Bush administration, ENEMY COMBATANT takes readers on a fantastical, adrenaline-packed journey from a smelter in Caucasia across the Turkish borderland to Homeland Security at JFK. Dark, comic and action-packed, ENEMY COMBATANT is the story of an aggrieved man acting out on the global stage, a raucous portrait of collateral damage from America's war on terror. "ENEMY COMBATANT covers a lot of territory, factually and metaphorically. It appropriates Americana, from road movies to virtual reality games, and provides -as the cliché goes -- 'a rollicking good time, ' while undercutting that notion entirely, as selfish, unaware, and dangerously self-serving. Sound like any country you've ever heard of? So, as I read it, this novel gathers its tropes and its metaphors as it speeds toward a kind of enlightenment for its two hazardously American male characters. It's obviously a cautionary tale and a cosmic warning. To make a bad pun: It's a take no prisoners book." - Ann Beattie, author of A Wonderful Stroke of Luck: A Novel "With his unsettling and completely original style, Winner brings together the buddy film, the war on terror and extravagant foreign settings in this novel that feels like a soon to be discovered blockbuster. Over and over, sentence by sentence we're caught off guard, leaving us in state of eerie suspense the whole book through." - Elizabeth McKenzie, author of The Portable Veblen: A Novel "David Winner's hypnotic page-turner, ENEMY COMBATANT, takes us back to the Bush era, during the Trump one. Winner's humor and agile imagination make the improbable story of two crazed Americans trying to rescue a prisoner from a CIA secret prison in Armenia both moving and believable." - Karl Geary, author of Montpelier Parade

Book Description
Part of the solution that was agreed to for air defense policies from the United States Navy was tactical air defense in the form of air combat fundamentals. Basic fighter maneuvers are a complex division that assembles numerous positional advantages. Aerodynamic flight operations take into consideration the geometry of pursuit and physics that manage a ratio between numerous areas that require specific energy calculations. The fundamentals of flight possibilities are proportionate to flight maneuvers. Basic aircraft assessments depend on a variety of attack positions that reveal numerous areas of internal national defense policies. If they are expected to be successful, aerodynamic energy and weight calculations depend on numerous considerations. Better angular positions also determine if effective measures can get a lock on the enemys defense. Opposition and requirements have to be determined if evasive estimates can be determined. All of these components usually determine numerous defensive positions of United States Naval pilots. Their maneuvers are carefully calculated and determine enemy attack positions that are offensive and successful at numerous radar locks. To be carefully positioned in range of the enemy requires power and evasive maneuvers. Angular positions relate to air-to-air weapon acquisitions and are carefully conducted to gain offensive positions. Once the determination is made that the enemy is impossible to track, pilots from the ceiling are called in to ambush the enemy and it is a tandem operation. Flushing him into a position that can be exploited by multiple other pilots is the objective of the United States military flight operations. Awareness of his acquisition strengths can reduce his tracking systems if proper weapons of mass destruction possibilities are to be considered. It is the intentions of the United States Navy to engage in numerous different angles that reveal a very complicated attack posture. To facilitate the escape of the enemy is also their area of expertise. Disengagement procedures do not occur until after the treaties have been established. The best tactical defense postures strategically position the United States Naval pilots. It is their duty to defend the air space and international waters of the United States. They are governed by the United Nations and their policies. They can assemble the best tactical defense postures in the world, and there usually is a multinational defense response when the intrusion alarm is sounded.

Enemy Combatants, Terrorism, and Armed Conflict Law

Enemy Combatants, Terrorism, and Armed Conflict Law PDF Author: David K. Linnan
Publisher: Bloomsbury Publishing USA
ISBN: 0275998150
Category : Law
Languages : en
Pages : 407

Book Description
With a renewed emphasis on national and homeland security, the United States is once again seeking to balance the needs of the state with both the rights of its citizens as well as those of other nations. This book represents an interdisciplinary approach to the legal dilemmas borne out by the war on terror-against the specific background of Afghanistan, Iraq, and this new kind of conflict. It is a strong contribution to a broader debate visible since 9/11, which will remain in the public eye for the foreseeable future. It addresses the overlap between religion, ethics, armed conflict, and law, within the context of the current conflict. While many issues in areas such as intelligence, reconciliation of civil liberties, dealing with terrorist threats, and the permissible bounds of interrogation, treatment of prisoners and laws governing armed conflict have long standing precedents under domestic and international law, this war has challenged even long standing legal interpretations. The contributors to this volume explore those precedents and contemporary challenges to them. Now that traditional wars between nation states are no longer the rule, the terrorist threat has gained credence (popularly, terrorism and its claimed breeding ground in failed states), linked in practice to issues of intervention on the territory of states harboring such groups. In military circles the idea of armed struggle between modern military forces and what were formerly called guerillas has now largely been replaced by asymmetric warfare and the concept of intelligence and preventive action interchangeably within U.S. borders and overseas. Opposing views contemplate that different-and presumably lower-legal standards may apply in internal armed conflicts. Such legal issues are visible under current circumstances of asymmetric warfare in conjunction with questions about prisoner status and detentions, including the permissible bounds of interrogation versus torture following the Abu Ghraib prison scandal in Iraq but also the treatment at the Guantanamo Bay facility of alleged Al Q'aeda captives from Afghanistan. All of the contributors in this book explore the changing circumstances against which these contentious new legal issues now unfold. The experts strike no consensus. Indeed, one of the work's many strengths can be attributed to the fact that the many facets of the ongoing debate are represented herein.
