Cada capítulo pretende ilustrar un significado y tensión particular, bien partiendo desde su concepción y evolución en la experiencia americana (capítulo I); pasando por la legitimidad del control judicial y su restricción u optimización de la democracia (capítulo II); así como por uno de los fenómenos que más ha impulsado el activismo judicial y los alcances del control de constitucionalidad, valga decir, el neoconstitucionalismo (capítulo III); hasta el estudio de dos cuestiones centrales en el constitucionalismo colombiano, de un lado, el hiperpresidencialismo, particularmente desde el estudio del control a las objeciones presidenciales (capítulo IV) y, de otro lado, la doctrina de la sustitución de la constitución como una garantía para el respeto de las decisiones fundamentales del poder constituyente originario (capítulo V). Esta obra también pretende fomentar la deliberación entre académicos, estudiantes, litigantes, funcionarios judiciales y demás operadores jurídicos.

This book delves into the conceptual changes produced by the Spanish constitutional debate held between 27 August and 9 December 1931. Taking place at the beginning of Spain’s Second Republic, those parliamentary deliberations brought about significant novelties in the political vocabulary. Concepts such as democracy, sovereignty, reform, revolution, and freedom, among others, were re-signified. This study investigates the conceptual contributions made by Spanish MPs in the course of the constitutional debate of 1931 by assuming, as a research approach, an interdisciplinary stance combining conceptual history, political theory, and parliamentary constitutional history. By doing so, it selects five determining issues: the pervasive discussion about two competing meanings of a democratic state; the rhetorical uses of reform and revolution; conceptual controversies about religious freedom; the disputed idea of property rights; and the functions of parliament and the president of the republic in a semi-presidential regime. The constitutional debate was largely inspired by interwar European constitutionalism which constituent representatives used to update the Spanish constitutional tradition. With that goal in mind, this book is aimed at undergraduate and graduate students and scholars working in the fields of conceptual history, political philosophy, parliamentary history, European political history, and European constitutionalism. Most party systems are relatively stable over time. Yet in the 1980s and 1990s, established party systems in Peru and Venezuela broke down, leading to the elections of outsider Alberto Fujimori and anti-party populist Hugo Chavez. Focusing on these two cases, this book explores the causes of systemic collapse. To date, scholars have pointed to economic crises, the rise of the informal economy, and the charisma and political brilliance of Fujimori and Chavez to explain the changes in Peru and Venezuela. This book uses economic data, surveys, and experiments to show that these explanations are incomplete. Political scientist Jason Seawright argues that party-system collapse is motivated fundamentally by voter anger at the traditional political parties, which is produced by corruption scandals and failures of representation.
