All regulations are costly and reduce personal freedoms. Some of them bring benefits in excess of these costs, but in recent decades many new regulations have been designed to produce benefits that are ephemeral and highly uncertain so that their value cannot be measured objectively for use in cost/benefit calculations. While legislators in principle are able to evaluate these ephemeral and uncertain benefits in the light of mandates from their constituencies, in practice they are evaluated by civil servants in regulatory agencies, many of which have been attracted to employment by these agencies because it offers them the opportunity to contribute to what they consider to be the creation of an ideologically better world in which market outcomes are modified by regulations. Efforts by the Trump administration and Republican Congress to reform the regulatory system faces very serious challenges to prevent these civil servants from continuing to have their estimates of the benefits influenced by their ideological preferences and thus bias the nature of future regulations.

Regulation has been shown to hinder employment and entrepreneurship, but regional variation is rarely explored. Engaging the theory of market-preserving federalism, we argue that regional economic freedom attenuates the negative influence of national regulation on net job creation. Using U.S. data, we find that regulation destroys jobs on net, but regional economic freedom moderates this effect. In regions with average economic freedom, a one percent increase in regulation results in 14 net jobs destroyed. However, a standard deviation increase in economic freedom attenuates this relationship by four fewer jobs destroyed. This moderation accrues strictly to older firms; regulation usually harms young firm job creation, and economic freedom does not attenuate this relationship.

The Economic Freedom of the World (EFW) annual reports have presented an economic freedom index for a large set of nations around the world. This index is designed to measure the degree to which a nation's policies and institutions protect its citizens' economic freedom. In this article, we explain the basic methodology employed in constructing the index and summarize the study's findings. Many factors influence the degree of economic freedom. Although no single statistic can capture all of them and their interrelations fully, the index presented here captures most of the important elements and provides a reasonably good measure of cross-country differences in economic freedom. The identification of these differences has been useful for researchers interested in the relationship between economic freedom and other economic variables such as income, economic growth, income equity, and environmental quality. To date, dozens of scholarly articles and hundreds of policy and journalistic reports have made use of the index.
