Excerpt from De l'Ordre Public en Droit International Privé Il serait cependant injuste de méconnaître les quelques résultats qui peuvent être considérés comme acquis. Sur certains points parti culiers des idées se sont imposées qui, si elles étaient plus nombreuses, pourraient arrher à constituer une véritable communauté de droitentre nations, communauté qui sans doute ne mettrait pas obstacle aux conflits, mais qui leur assurerait, en tout lieu, une solution uni forme basée sur les données de la raison et conforme aux exigences de la pratique. De ce nombre est le principe qui doit faire l'objet de cette étude. Il est aujourd'hui universellement admis que l'application d'une loi étrangère ne saurait en aucun cas être tolérée, alors qu'elle aurait pour conséquence de troubler l'ordre public du pays dans le quel elle est demandée. Aussi bien, n'est - cc pas là une notion de simple bon sens? Si l'on veut que l'application des lois étrangères ne soit jamais due qu'à la courtoisie de l'état qui l'accorde, comment penser que cette courtoisie pourrait jamais aller jusqu'à lui faire sa crifier ses intérêts vitaux, son ordre public, et si l'on pense que l'ap plication d'une loi étrangère peut être un véritable droit pour celui qui la réclame, incontestablement ce droit ne pourra jamais être mis en balance avec le droit k plus fort qui appartient à chaque peuple, de veiller à sa propre conservation en prohibant tout ce qui pourrait se produire, sur son territoire, de dangereux à ce point de vue. Le res pect de l'ordre public, voilà donc un principe qui s'impose à tous, qui se retrouve dans les opinions les plus diverses, qui fait réelle ment partie de cette communauté de droit à laquelle il a été fait allu sion tout à l'heure. Même, si quelque chose doit étonner, c'est que ce principe n'ait pas été reçu de tout temps, c'est aussi que dans le droit contemporain il ne soit pas entendu de la même façon par tous ceux qui le recon naissent. Car, il faut bien l'avouer, dans la manière d'expliquer et de limiter ce principe, il y a encore de grandes incertitudes, nombre de doutes dans les applications qu'il s'agit d'en faire.
