Spanish Abstract: Es de una vigencia notable la protección del patrimonio cultural en un contexto global. Cabales ejemplos son las destrucciones de los Budas de Bamiyán en Afganistán y la destrucción de Tombuctú en Mali. Este breve artículo analiza con una perspectiva crítica el bien jurídico protegido por la Convención sobre la Protección del Patrimonio Mundial Cultural y Natural de 1972 a la luz de los derechos culturales reconocidos en el derecho internacional de los derechos humanos. A modo de conclusión preliminar, y como parte de una investigación de mayor extensión, este breve capítulo observa que el único fundamento de la Convención radica en la perpetuidad de determinados bienes considerados de valor universal excepcional desde el punto de vista histórico, estético, etnológico, artístico, científico o antropológicolos, sin que se observe una conexión directa a los derechos humanos.
