The overall procurement function is clearly an inherently governmental function. However, it can be argued that some functions within procurement are not inherently governmental. Many have identified that Department of Defense (DoD) personnel levels have dropped and that activity rates for procurement organizations have increased. This has driven a gap between the requirements and the organic capability in many DoD contracting offices. This dilemma of an overall inherently governmental function, yet a shortfall in personnel to perform the overall function, provides the motivation for this study. Eighteen DoD agencies/ commands and six non-DoD agencies responded to a survey to determine the current practice. The study determines that government agencies display considerable variety in their use of contractor support for procurement functions. The government must be very careful when contracting out procurement functions. Government leaders must maintain their ability to thoroughly control their policy and management functions. Contracting out a function must not inappropriately restrict agency management in their ability to develop and consider options. This report does not identify or recommend specific procurement functions that should or should not be contracted out. Less sensitive procurement tasks such as contract closeout and market research seem to be appropriate. More sensitive tasks such as negotiation and reviewing contractor performance would be less likely candidates. This report recommends the manager retain the ability and the option to assess the local environment and requirements, and to make a proper choice. For management purposes, it is recommended that each contracting activity be limited in the percentage of their workforce that may be contracted out.

Among other topics, the Commission on Roles and Missions of the Armed Forces considered whether the Department of Defense (DoD) should contract out--outsource--support services that DoD now produces in-house and, if so, (1) which services DoD should outsource and (2) what DoD can do to make outsourcing more cost-effective. This report reviews a set of issues relevant to these questions. The report first reviews barriers and objections to outsourcing that have been raised by earlier studies and government commissions that have addressed outsourcing. It then reviews insights from commercial-sector experience with outsourcing that DoD could use to guide its own actions on outsourcing. Finally, it offers suggestions about how to structure an implementation plan for large-scale outsourcing of support services. In particular, it identifies the attributes of support activities that DoD should consider outsourcing first and how DoD could facilitate an outsourcing program.

Overreliance on outsourcing Department of Defense (DoD) functions to private contractors is undermining the organic strength and capabilities of the United States military. Since the end of the Cold War there has been a steady rise in the use of private business organizations to accomplish missions and duties typically assigned to the military. The tremendous expansion of contractors on the battlefield in highly critical operational areas is a trend that is escalating across the DoD. Contractors, in unprecedented numbers, have expanded their role from supporting CONUS missions to embarking on the battlefield in defense of our nation. As this trend continues to expand within the DoD, and as contractors' roles broaden in scope and become blurred with military missions, it is imperative that the DoD reevaluate those services that are suitable for outsourcing, and that critical improvements are made to the contracting process and oversight for such services. This study focuses primarily on identifying the mounting issues related to DoD outsourcing and addresses potential solutions to mitigate the negative effects. DoD outsourcing must become more transparent to the taxpayers. An assessment of all DoD contracts is necessary to determine which inherently governmental functions are being performed by contractors. Those critical functions must be retained by the government and made ineligible for future outsourcing. Contractor immunity abroad has had a devastating effect on coalition legitimacy. Legal accountability for contractors working abroad must be implemented and enforced. Purported savings from outsourcing must be validated. Lack of immediate and substantial reforms to the outsourcing process and a thorough review of what functions are available for outsourcing could result in irrevocable damages to military competency.
