Book Description
Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides ready access to the law applied to cases involving cross border issues in the Czech Republic. It offers every lawyer dealing with questions of conflict of laws much-needed access to these conflict rules, presented clearly and concisely by a local expert. Beginning with a general introduction, the monograph goes on to discuss the choice of law technique, sources of private international law, and the relevant connection with other laws. Then follows clear description and analysis of the rules of choice of law on natural and legal persons, contractual and non-contractual obligations, movable and immovable property, intangible property rights, company law, family law (marriage, cohabitation, registered partnerships, matrimonial property, maintenance, child law), and succession law (including testamentary dispositions). The presentation concludes with an overview of relevant civil procedure, examining lex fori and issues of national and international jurisdiction, acceptability and enforcement of foreign judgements, and international arbitration. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for lawyers handling cases in the Czech Republic. Academics and researchers, as well as judges, notaries public, marriage registrars, youth welfare officers, teachers, students, and local and public authorities will welcome this very useful guide, and will appreciate its value in the study of private international law from a comparative perspective.

Unilateral Sanctions in International Law
Author: Surya P Subedi
Publisher: Bloomsbury Publishing
ISBN: 1509948392
Category : Law
Languages : en
Pages : 368
Book Description
This is the first book that explores whether there are any rules in international law applicable to unilateral sanctions and if so, what they are. The book examines both the lawfulness of unilateral sanctions and the limitations within which they should operate. In doing so, it includes an analysis of State practice, the provisions of various international legal instruments dealing with such sanctions and their impact on other areas of international law such as freedom of navigation, aviation and transit, and the principles of international trade, investment, regional economic integration, and the protection of human rights and the environment. This study finds that unilateral sanctions by a state or a group of states against another state as opposed to 'smart' or targeted sanctions of limited scope would be unlawful, unless they meet the procedural and substantive requirements stipulated in international law. Importantly, the book identifies and consolidates these requirements scattered in different areas of international law, including the additional rules of customary international law that have emerged out of the recent practice of States and that increase the limitations on the use of unilateral sanctions.

Trans Rights and Wrongs
Author: Isabel C. Jaramillo
Publisher: Springer Nature
ISBN: 3030684946
Category : Law
Languages : en
Pages : 552
Book Description
This book maps various national legal responses to gender mobility, including sex and name registration, access to gender modification interventions, and anti-discrimination protection (or lack thereof) and regulations. The importance of the underlying legislation and history is underlined in order to understand the law’s functions concerning discrimination, exclusion, and violence, as well as the problematic nature of introducing biology into the regulation of human relations, and using it to justify pain and suffering. The respective chapters also highlight how various governmental authorities, as well as civil society, have been integral in fostering or impeding the welfare of trans persons, from judges and legislators, to medical commissions and law students. A collective effort of scholars scattered around the globe, this book recognizes the international trend toward self-determination in sex classification and a generous guarantee of rights for individuals expressing diverse gender identities. The book advocates the dissemination of a model for the protection of rights that not only focuses on formal equality, but also addresses the administrative obstacles that trans persons face in their daily lives. In addition, it underscores the importance of courts in either advancing or obstructing the realization of individual rights.

Living in the Merry Ghetto
Author: Trever Hagen
Publisher:
ISBN: 0190263857
Category : History
Languages : en
Pages : 201
Book Description
Living in the Merry Ghetto reframes how people use music to build resistance. Author Trever Hagen addresses the social context of illegal music-making in Czechoslovakia during state socialism. He tells the story of a group of rock'n'roll musicians who went underground after 1968, building a parallel world from where they could flourish: the Merry Ghetto. The book examines the case of the Czech Underground and the politics of their music and their way of life, paying close attention to the development of the ensemble The Plastic People of the Universe. Taking in multiple political transitions from the 1940s-2000s, the story focuses on non-official cultural practices such as listening to foreign radio broadcasts, seeking out copied cassette tapes, listening to banned LPs, growing long hair, attending clandestine concerts, smuggling albums via diplomats, recording in home-studios and being thrown in prison for any of these activities. Drawing on ethnographic interviews with Undergrounders, archival research and participant observation, Hagen shows how these practices shaped consciousness, informed bodies and promoted collective action, all of which contributed to an Underground identity.
