Por su parte, la Unión Europea lanzó en 2015 una estrategia política conocida como Estrategia para el Mercado Único Digital de la Unión Europea, con la intención de acometer la necesaria recepción jurídica de la Revolución Digital y aprovechar al máximo el potencial económico que representa. Hasta el momento las iniciativas normativas (entre Propuestas de Directiva, y de Reglamento) superan las cuarenta, y es difícil llevar la cuenta de las otras muchas iniciativas que aún no se han traducido en textos articulados.Dos de los conceptos jurídicos clave sobre los que pivota la recepción jurídica de la Revolución Digital en lo que al Derecho patrimonial privado se refiere son los de “contenidos digitales”, y “datos”. Los primeros son definidos como “datos producidos y suministrados en formato digital”; los segundos, comienzan a verse ya como una importante mercancía objeto de Intercambi, hasta el punto ser calificados como “la sangre de las venas” de la economía digital. En este trabajo analizamos el tratamiento jurídico que están recibiendo o que probablemente reciban estas nuevas realidades desde una perspectiva y una convicción muy concretas: resulta necesaria una actualización del concepto jurídico-patrimonial de bienes a nivel europeo que sea capaz de acoger estas nuevas realidades, de tal manera que puedan circular del mismo modo que cualquier otro bien, y la nueva riqueza digital no quede estancada en una suerte de resurrección (digital) del paradigma de la “propiedad en manos muertas”.
