Since copyright laws have not adapted well to modern technology and in many cases have consequently inhibited artistic innovation, there is a need to advance copyright and advocate for digital artists whose work depends on digital reproduction. This thesis explores where legal advocacy for new technology in the arts is today and questions the kind of advocacy that is needed to address issues of digital copyright. Artists whose work establishes innovative purposes and meanings for new technologies inherently challenge the legal boundaries of artistic originality and ownership, therefore they struggle with the acceptance of their practice as legitimate creative expression. At the core of this paper is the argument that the fair use doctrine, a limitation to copyright law, is a productive avenue for conducting the adaptation of copyright in favor of digital artists. The following research considers artist’s general confusion about copyright law and assesses the difficulties that they face working with emerging technology. Although copyright law seems to best define what one cannot do, it is the purpose of this thesis to inform digital artists and arts administrators that they have the power to validate the technology they work with, which could ultimately change the course of that technological development. By pushing for legal advocacy within an art world that tends to perceive the law as canonical, this paper demonstrates that artists can act as agents through active interpretation of the law.
