En la actualidad, el derecho minero en Colombia presenta una serie de desafíos debido principalmente a cuatro razones: en primer lugar, al crecimiento exponencial de solicitudes y de concesiones mineras en los últimos años que han desbordado la capacidad de las instituciones públicas, en segundo lugar, a la derogatoria y suspensión de normas que han generado inseguridad jurídica y desconfianza en los inversionistas extranjeros; en tercer lugar, a la alta tasa de ilegalidad que sitúa al país entre los primeros con mayor número de minas en operación sin el correspondiente título minero y finalmente, en cuarto lugar, a los impactos sociales y ambientales que puede causar la actividad. En razón a lo anterior, este libro ofrece un estudio detallado de los principales asuntos regulatorios en materia minera en Colombia justamente en un momento crucial en el que el país se prepara para una nueva etapa en la historia, un momento en el que el postconflicto permitirá recuperar la confianza inversionista, el aumento de las plazas de empleo en la industria minera, el desarrollo y recuperación de los proyectos mineros en diversas áreas del país, así como el desarrollo de una nueva minería que se ajuste al modelo de desarrollo de Colombia.
